In Crimea, some innovations in the implementation of the “garage amnesty” were explained

Deputy Chairman of the Council of Ministers of the Republic of Crimea Anna Anyukhina explained some of the innovations in the implementation of the “garage amnesty”. According to her information, the corresponding amendments are stipulated by Federal Law No. 338-FZ “On garage associations and on amendments to certain legislative acts of the Russian Federation” that came into force on October 1, 2023.

So, for example, boundary and technical plans for registration of a garage will not be needed if the garage box and the area under it are already registered in the cadastral register.

Previously, the legislation contained requirements for interested parties to provide technical and/or boundary plans to complete the registration of rights to the garage and the land plot underneath it. Now, for the “garage amnesty” procedure, there is no need to produce these documents again if they were made earlier and on their basis the state cadastral registration of the garage and the land located under it has already been carried out. Thus, the legislator eliminated duplication of this procedure, which will allow the property owner to save time and money.

The Deputy Prime Minister emphasized that it is necessary to remember that registration of rights to a garage is carried out solely on the basis of title documents for the land plot on which the object is located. The absence of a connection between the garage building and the land plot, or vice versa, is the basis for performing cadastral work for further indication in the Unified State Register of Real Estate (USRN) information about the boundaries of which land plot this garage is located.

Legislative amendments also bring clarity to the conceptual framework. Thus, a garage is clearly understood as a non-residential building intended exclusively for storing vehicles. It may have basements and no more than two floors. At the same time, owners should take into account that the garage area should not exceed 60 square meters,” Anna Anyukhina clarified.
