In Russia, crimes using IT may be classified as aggravating circumstances

Minister of Internal Affairs Vladimir Kolokoltsev instructed to study the issue of classifying crimes using IT technologies as aggravating circumstances in the Criminal Code of the Russian Federation (CC), they reported «News».

Recommend that the Investigative Committee of Russia (A. I. Bastrykin) together with the Ministry of Internal Affairs of Russia (V. A. Kolokoltsev) and other interested departments work out issues regarding the addition: 16.1. Article 63 of the Criminal Code of the Russian Federation introduces a new aggravating circumstance “committing a crime using information and communication technologies,” as stated in the document.

In addition, it is proposed to supplement Articles No. 104.1, No. 5 and No. 115 of the Criminal Code of the Russian Federation with provisions establishing the possibility of confiscation of digital currency recognized as property used to violate the Criminal Code of the Russian Federation.

It is reported that the first results of the work must be presented before December 1, 2024.

The number of crimes using IT technologies is increasing every year, noted Anton Nemkin, a member of the State Duma Committee on Information Policy, Information Technologies and Communications.

According to statistics from the Ministry of Internal Affairs, 677 thousand IT crimes were recorded in 2023. The increase compared to the previous period was almost 30% — in 2022, the department recorded 522 thousand IT crimes. Information technology is indeed becoming an effective tool in the hands of attackers— said the deputy.

Nemkin recalled that IT crimes include: interference with the operation of corporate and government information systems, distribution of malware, theft of personal user data, hacking of personal pages on the Internet and the creation of phishing resources.

In addition, this may include the dissemination of illegal information using IT technologies. For example, materials that incite ethnic hatred and slanderous messages addressed to a specific citizenhe said.

According to the deputy, our country is now at the stage of developing a systematic policy regarding IT crimes.

This concerns both changes in regulatory provisions and the active inclusion of the business sector, including through the development of their own initiatives. First of all, this relates to the problem of fraud and DDoS attacks. In fact, the main task of both business and the state is to present a united front— the deputy is sure.

However, we need to wait for more details of the instructions from the relevant departments, Nemkin noted.
