In Russia, new rules for handing over a foreign passport in case of a ban on traveling abroad have come into force.

On December 11, 2023, new rules on the procedure for entry and exit from the territory of the Russian Federation will come into force. The document establishes the procedure for invalidating a foreign passport and a list of reasons for its invalidity, and also introduces a requirement to confiscate foreign passports for citizens for whom travel outside the Russian Federation is prohibited.

The changes were developed and submitted to the State Duma back in 2021, but they were adopted only this summer. Legislators had long debates regarding some points of the novel. Eventually, a compromise was worked out that satisfied all sides of the legislative process.

Perhaps the most important change is the emergence of an obligation for citizens to hand over their foreign passport to a government agency if they are prohibited from traveling outside the country. The law provides for different reasons for the ban: debt obligations, criminal charges, failure to comply with court decisions, military service, and so on. Now, if such a ban is received, a citizen is obliged to surrender his foreign passport to a government agency within 5 days. When handing over your passport, an acceptance document will be issued in two copies, one of which the citizen will receive in his or her hands. If a citizen wishes to return his foreign passport after completing military service, he will be required to provide a military ID with a mark on completion of service.

The novel also establishes a list of reasons that allow a foreign passport to be invalidated. This list includes: changes in a citizen’s personal data, expiration of a document, termination of citizenship. The Ministry of Internal Affairs will keep a record of valid and invalid passports. The database will be formed based on current data from the Ministry of Internal Affairs.
