In Sevastopol, a verdict was brought in the case of causing damage during the repair of the summer stage of Primorsky Boulevard “Rakushka”

Having agreed with the position of the state prosecutor of the prosecutor’s office of the city of Sevastopol, the court issued a guilty verdict in a criminal case against the director of the state budgetary cultural institution of the city of Sevastopol «Andreevsky Palace of Culture».
He was found guilty under paragraph “c” of Part 3 of Art. 286 of the Criminal Code of the Russian Federation (exceeding official powers causing grave consequences) and Part 1 of Art. 243 of the Criminal Code of the Russian Federation (damage to cultural heritage sites (historical and cultural monuments) of the peoples of the Russian Federation included in the unified state register of cultural heritage sites (historical and cultural monuments) of the peoples of the Russian Federation). It was established that in the period from May to September 2020, the director of the institution exceeded his official authority when carrying out repairs to the summer stage of Primorsky Boulevard “Rakushka”, as a result of which damage occurred to individual elements of the cultural heritage site of regional significance “Primorsky Boulevard — a complex monument of history, architecture and gardening”. park art», within the boundaries of which it is located, — reported the press service of the Sevastopol prosecutor’s office.
Since 2018, the summer stage has been assigned to the State Budgetary Institution of Sevastopol “Andreevsky Palace of Culture” with the right of operational management.
In 2019, on the basis of government contracts concluded by the institution, two packages of design and estimate documentation for the auditorium with the arrangement of the roof and the chess club were developed as part of the overhaul of the stage building. However, in violation of the requirements of the legislation on objects of cultural heritage of the peoples of the Russian Federation, these contracts did not contain mandatory sections on ensuring the safety of the object, agreed with Sevnasledie.
Despite this, in July 2020, knowing for certain that the developed design and estimate documentation did not meet the requirements of the law, the head of the State Budgetary Institution of Sevastopol “Andreevsky Palace of Culture” concluded an agreement on behalf of the institution to carry out major repairs on its basis.
During the work on the site located directly in front of the building of the summer stage «Rakushka», the contractor built capital construction objects about four and two meters high: an equipment booth and an amphitheater, and also installed racks (trusses) for equipment. Due to the fact that the construction of these buildings contradicted the requirements of the legislation on the protection of cultural heritage sites and led to a violation of the original appearance of the boulevard, major repairs were suspended in September 2020. Subsequently, these structures were dismantled.
Thus, the city budget suffered damage in the amount of more than 25.5 million rubles.
A criminal case on this fact was initiated based on materials from the prosecutor’s office of the city of Sevastopol and the Federal Security Service of Russia for the Republic of Crimea and the city of Sevastopol. The investigation was carried out by the Sevastopol Interdistrict Investigative Department of the Main Investigative Directorate of the Investigative Committee of the Russian Federation for the Republic of Crimea and the city of Sevastopol.
The Nakhimovsky District Court of Sevastopol, taking into account the opinion of the public prosecutor of the city prosecutor’s office, sentenced the perpetrator to serve a sentence of 3 years of suspended imprisonment with a probationary period of 3 years, with deprivation of the right to hold certain positions in state bodies and local governments for a period of 2 years.
In addition, the court satisfied the civil claim of the Government of Sevastopol, supported by the state prosecutor, to recover from the perpetrator more than 25.5 million rubles in compensation for the damage caused.
The verdict did not enter into legal force.
