Agreeing with the position of the public prosecutor of the prosecutor’s office of the city of Sevastopol, the court delivered a guilty verdict against two local residents who were engaged in illegal mining on a land plot located at the address: Sevastopol, Nakhimovsky district, Kachinskoe highway, 44-A, and adjacent to him the lands of the city of Sevastopol.

They were found guilty under paragraph «a» part 2 of Art. 171 of the Criminal Code of the Russian Federation (illegal entrepreneurship, i.e. carrying out entrepreneurial activities without a license, if this act caused major damage to the state and is associated with the extraction of income on a large scale, committed by an organized group). It was established that convicts, through legal entities controlled by them, without having a license for the use of subsoil, from April to November 2019 carried out mining. Using vehicles, special equipment and involved workers on an agricultural land plot located in the water protection zone in the Language Balka of the city of Sevastopol, they carried out earthworks under the guise of carrying out anti-landslide measures. At the same time, by gradually removing layers of soil, they extracted the common mineral “pebbles” from the bowels, which was sold at a reduced cost to other legal entities.— noted in the press service of the prosecutor’s office of Sevastopol.

Thus, more than 54 thousand tons of pebbles were illegally mined, which caused damage to the city of Sevastopol in the amount of almost 81 million rubles. From their illegal activities, entrepreneurs received income in the amount of more than 3 million rubles.

The criminal case was initiated based on the materials of the inspection of the Sevastopol Interdistrict Environmental Prosecutor’s Office. The investigation was conducted by the investigative department of the Ministry of Internal Affairs of Russia for the city of Sevastopol. During the investigation, real estate objects, vehicles, special equipment and other property of one of the accused were seized.

The Nakhimovsky District Court of Sevastopol sentenced the guilty to a fine of 450,000 rubles each.

In addition, the court satisfied the civil claim of the Government of the city of Sevastopol, supported by the public prosecutor, to recover from the perpetrators the material damage caused by the crime in the amount of almost 81 million rubles.
