In Sevastopol, a verdict was sentenced in the case of embezzlement of funds under the guise of shared construction of the house

Agreeing with the position of the state prosecutor of the prosecutor’s office of the city of Sevastopol, the court issued a conviction in a criminal case against three participants in an organized group — citizens of the Russian Federation 1977, 1976 and 1975.

They are found guilty under Part 4 of Art. 159 of the Criminal Code (fraud) and part 4 of Art. 159.2 of the Criminal Code (fraud upon receipt of payments).

A criminal case was instituted based on the materials of prosecutorial inspections. The investigation was conducted by the Investigative Department of the Ministry of Internal Affairs of Russia in Sevastopol in interaction with the UEBIPK of the Ministry of Internal Affairs of Russia in Sevastopol.

It was established that convicts with the aim of theft of citizens’ funds under the guise of their participation in shared construction of an apartment building at the address: Sevastopol, ul. Gaven, d. 7, created the housing and construction cooperative «House by the Sea.»

In the period from April 2016 to October 2019, accomplices organized the functioning of the cooperative in offices in the territory of the Leninsky district of Sevastopol. To attract shareholders, they placed advertisements and distributed information through realtors.

As a result, they managed to mislead 19 residents of Sevastopol, Vladivostok, Moscow, Murmansk, Petropavlovsk-Kamchatsky, St. Petersburg, Kemerovo and Moscow regions, the Republic of Crimea and other regions. In total, the victims transferred more than 20 million rubles to the participants of the organized group as share contributions.

In fact, the attackers did not have title documents for the land at the specified address, design documentation and construction permits.

In addition, in the period from June 2016 to June 2017, they presented 6 citizens of maternal capital, uninhabited about their criminal intentions, obviously false and inaccurate information about the construction of this apartment building to the territorial bodies of the Pension Fund of the Russian Federation. Having deceived the authorized officials of these bodies, they bowed them to transfer maternal capital to bank accounts of the housing cooperative “House by the Sea” worth more than 2.5 million rubles.

Previously, these same persons have already been sentenced to imprisonment for similar actions against 63 other victims.

Now, the Leninsky District Court of Sevastopol, by the totality of all crimes, imposed a final punishment for them in the form of imprisonment for 7 years, 7 years and 9 years 10 months with serving in a penal colony of general regime.

In addition, the court partially satisfied the civil lawsuits supported by the state prosecutor to recover material damage caused by the crime from the guilty persons, and satisfied the claim of the prosecutor in the interests of the pension bodies. The arrest imposed on cars and land plots of accomplices was upheld.
