In Sevastopol, it is illegal to use the land of the Laspi state nature reserve

The Balaklava District Court of Sevastopol satisfied the claim of the Sevastopol Interdistrict Environmental Prosecutor for the release of the specially protected natural territory of the Laspi nature reserve from illegally erected buildings.
As previously reported, the environmental prosecutor’s office checked the legality of economic use of lands in specially protected natural areas. It has been established that a commercial organization has begun the creation of a tourist base within the boundaries of the Laspi state nature reserve. As part of the design decisions, it was planned to construct a complex of tourist infrastructure, including four modular buildings that could provide accommodation for up to 20 people. At the time of the prosecutor’s inspection, two buildings were erected on a piled concrete foundation.
At the same time, during the construction of the complex it was not taken into account that the development territory is a state nature reserve, and the regime of its use does not provide for economic development.
In order to eliminate the violations committed, the environmental prosecutor sent a statement of claim to the court imposing on the organization the obligation to vacate the reserve’s lands by dismantling the erected structures.
The claim was satisfied. At the request of the prosecutor, the court imposed interim measures in the form of a ban on the use of the land plot for the purpose of organizing recreation areas.
The actual elimination of violations is under control of the prosecutor’s office.
In addition, the investigation into the criminal case under Art. 262 of the Criminal Code of the Russian Federation (violation of the regime of specially protected natural areas and natural objects), initiated on this fact by the investigative authorities based on the materials of the prosecutor’s inspection.
