In Sevastopol, the police exposed the fraudulent developer

In Sevastopol, the investigation of a criminal case against a fraudster who fraudulently stole more than 17.2 million rubles was completed. This was reported by the press service of the Ministry of Internal Affairs for the city of Sevastopol.

During the preliminary investigation, it was established that a 55-year-old local resident, under the pretext of selling residential premises in apartment buildings under construction, stole more than 17.2 million rubles from 20 residents of Sevastopol, the Republic of Crimea, Krasnodar Territory, Leningrad, Samara and Chelyabinsk regions.

For the successful implementation of the criminal scheme, the attacker found a land plot along 1st Sarandinaki Street in the Leninsky District of Sevastopol, intended for the construction and maintenance of a residential building, outbuildings and structures. The man entered into a lease agreement with the owner of the land plot with the right to purchase, in order to subsequently use the specified land plot to deceive his clientsthe message says.

In order to attract victims and mislead them, the defendant posted on the Internet, including on various social networks, information about the preliminary sale of housing in apartment buildings under construction, rented office space, and hired workers who were not aware of the criminal intent of his employer.

To create the appearance of legal activity, the man produced preliminary designs for the construction of multi-apartment residential buildings with graphic materials, the same type of documents on the acquisition of residential premises, and also organized the production of work on the unauthorized construction of two multi-apartment residential buildings on a land plot in violation of the permitted type of its use.

In order to encourage potential buyers to purchase residential premises and transfer funds on an especially large scale, the defendant assured the victims that after the commissioning of the constructed residential buildings, he would change the type of permitted use of the land plot and carry out cadastral registration of houses precisely as multi-apartment buildings, as well as will re-register the necessary documents of apartment owners.

Being confident that they were dealing with a conscientious developer, the victims entered into contracts with him and transferred funds as payment for the housing they purchased in an apartment building under construction.

Knowing in advance that the buildings under construction are not subject to registration in the manner prescribed by law as multi-apartment residential buildings, the accused, in the absence of a construction permit due to a mismatch in the type of permitted use of these land plots, under the pretext of selling residential premises, stole money, after which he spent them for the further implementation of the fraudulent scheme and their needs.

In the office space rented by the swindler, search activities were carried out, preliminary contracts for the sale and purchase of residential premises concluded with buyers, agreements on making targeted share contributions, receipts for the receipt of funds by the accused, as well as other documentation confirming his fraudulent activities were seized. During the preliminary investigation, the attacker’s real estate was seized for a total amount of more than 10.5 million rubles.— noted in the Sevastopol police.

The attacker was charged under Part 4 of Art. 159 of the Criminal Code of the Russian Federation (“Fraud”). The sanction of the article provides for punishment in the form of imprisonment for up to 10 years.
