In Simferopol, bailiffs helped a mother get her son back

Family relationships cannot always be called smooth. They often affect not only parents, but also children growing up in families. In the latter case, this means that children become hostage to circumstances that have to be sorted out through legal proceedings.
A similar situation arose between citizen P. and citizen S., residents of Simferopol, who were previously husband and wife. Having dissolved the marriage, citizen P. decided that their common minor son would live with him and took him into his home, thereby violating the court decision, according to which it was determined that the child should have lived with his mother. As a result, the bailiff of the bailiff department for the Simferopol district of Simferopol of the Main Directorate of the Federal Bailiff Service of Russia for the Republic of Crimea and the city of Sevastopol initiated enforcement proceedings against citizen P. In turn, the debtor ignored the legal demands of the enforcement officer.
For untimely execution of a court decision, the bailiff issued a resolution against citizen P. to collect an enforcement fee in the amount of 5 thousand rubles, seized his bank accounts, and temporarily limited the debtor from using a special right in the form of the right to drive vehicles until the requirements of the enforcement document are fulfilled. in full, and also temporarily limited his right to travel outside Russia. But citizen P. not only did not meet his ex-wife, but decided to hide the whereabouts of the child.
When it was established that the minor son of citizen S. was at the place of residence of citizen P., the latter tried in every possible way to limit the claimant’s access to his child. Subsequently, the bailiff of the bailiff department for the Simferopol district of the city of Simferopol of the Main Directorate of the Federal Bailiff Service of Russia for the Republic of Crimea and the city of Sevastopol appealed to the court with a demand to open the residential premises belonging to citizen P., with subsequent entry. The department’s bailiff’s request was satisfied and soon an employee of the enforcement authorities went to the debtor’s residence address, but did not find the child there. When leaving again, the door to the bailiff of the department was opened by the mother of citizen P., who stated that she did not know where her son and grandson were. During the inspection, a locked room was discovered in the debtor’s home. Then, in the presence of employees of the enforcement authorities, as well as employees of the guardianship and trusteeship authorities, the invited specialist opened the door of the locked room where citizen P. and his minor son were located. After which the child was immediately removed and transferred back to citizen S.
In addition, the bailiff of the department drew up administrative protocols under Art. 17.8 of the Code of Administrative Offenses of the Russian Federation and submitted the materials for consideration to the court. Enforcement proceedings ended with actual execution.
