In transactions involving a non-resident, legal entities must independently provide data on the citizenship of the participants in the organization

The State Committee for State Registration and Cadastre of the Republic of Crimea recommends that when applying for a transaction involving a non-resident, legal entities independently provide information about the citizenship of the participants in the organization. Recall that in accordance with the Decree of the President of the Russian Federation No. 81 in Russia, from March 2 2022 there is a special procedure for registering real estate transactions between residents and non-residents of the Russian Federation associated with hostile states. If the applicant is a legal entity, the committee is advised to independently provide information about the citizenship of the participants in the organization. This information can be submitted in the form of a list of persons indicating the full name, date and place of birth, passport data. For the purpose of legal expertise, state registrars will have to verify this information by sending appropriate requests to the bodies of the Ministry of Internal Affairs.
Timely receipt of such information by us is in the interests of the applicants themselves. If the citizenship of the participants of the legal entity is not initially reported, the state registration of the transaction will be suspended, and the applicant will receive an official notification about the need to provide this information. As a result, extra time will be spent collecting and submitting this information. If we have this information immediately, we will send a request to the Ministry of Internal Affairs faster, which in general will significantly shorten the procedure for processing the transaction , — says Yulia Zhiganova, Deputy Chairman of the State Register of Registration.
The deputy head of the department also added that legal entities in the form of joint-stock companies are recommended to provide the State Committee for Register of Shareholders with an extract from the register of shareholders indicating the presence or absence of foreign persons as shareholders.
