New practice: citizens began to actively contact notaries to document poor repairs or poor quality work of the developer. Stamped documents are needed for legal proceedings. Details reported «Rossiyskaya Gazeta» in the Federal Notary Chamber:

Over the five months of 2024, the total number of requests to notaries to provide evidence increased by 17% — to 17.5 thousand, — said the FNP. — Over the entire last year, there were 39.2 thousand such requests, an increase of 15 percent compared to 2022.

According to independent experts, the growth of such actions is ensured, among other things, by citizens dissatisfied with renovations in apartments or developers. Providing evidence is a notarial act when a notary records facts. For example, that the wallpaper on the walls is falling off. Sometimes this is quite a legal fact that needs to be properly sealed for subsequent legal proceedings.

Often, people who want to document poor-quality repairs in order to recover money from an unscrupulous contractor turn to notaries to provide material evidence.— they say at the notary office.

An example from Perm: a contractor had to make repairs in a residential building, change the roof, build an extension with a swimming pool. They promised to finish it in November, but they couldn’t. It was already snowing, but the house still stood without a roof. To preserve evidence of improper provision of services by previous masters, they recorded the evidence with the help of a notary. He also appointed a construction inspection.

A Moscow notary tells how he inspected non-residential premises in a 7-story administrative building. The total area was over 5.5 thousand square meters. A photographer was brought in to help document the situation and took fifteen hundred photographs. Another case from practice: shareholders who were worried that the developer would not deliver the property on time turned to the notary. The house was supposed to be built in two years, but several months before the deadline, a foundation pit with piles was still standing in its place. This was what needed to be recorded correctly. Thanks to the protocol with the notary’s seal, the applicants were able to terminate the contract and return the money paid with interest.
