The ban is associated with ensuring fire safety, said lawyer Alena Borzova. She clarified that the ban was established by Art. 88 Federal Law «Technical Regulation on Fire Safety requirements.» This is due to the fact that personal belongings can burn out evacuation routes. At the same time, it does not matter what kind of things the tenants leave in the entrance. It is forbidden to store both a overall dilapidated sofa and a small baby stroller in the entrance.

According to Article 20.4 of the Administrative Code of the Russian Federation, citizens can be fined for cluttering the stairwell of citizens in the amount of 5 thousand to 15 thousand rubles. The penalty for officials is higher — from 20 thousand to 30 thousand rubles, for individual entrepreneurs — from 40 thousand to 60 thousand rubles. A separate fine is provided for unsanitary conditions for the stairwell — from 500 to 1,000 rubles. If clutching the entrance leads to a fire, damage to someone else’s property, a fine for individuals will be from 40 thousand to 50 thousand rubles. At the death of a person, the culprit will face up to 5 years of forced work or prison.

In some cases, residents can legalize the storage of personal belongings in the entrance. This will require not only the consent of the neighbors, but also the correspondence of places for storage by technical standards.

In order to legitimize the storage of things in the entrance, you need to find a place that meets the fire standards that does not block the paths to the evacuation exit. Then you need to hold a general meeting of residents. It is necessary to warn about its own owners of apartments in at least 10 days. The decision adopted by the results of the vote must be familiarized within 10 days.

Most often, difficulties arise with fire standards, notes Alexander Bobrov. In the rules of the fire regime, the minimum width of the passage on the evacuation routes is not defined, so the presence of any things there is considered clutter. It can be distinguished under the storage of things, located not on the way to the exit. For example, in some series of houses there is a free space near the elevator or stairs.
