Likbez: registration in an apartment — 5 main myths

CrimeaPRESS reports:

Registration at the place of residence is a mandatory item in the passport of a citizen of the Russian Federation. Despite all the officiality and regulation by law, this stamp is shrouded in a web of rumors and myths. Their debunking in the material of the portal Domclick.

Myth 1. Registered — you can’t evict

You gave your husband, girlfriend, wife’s second cousin or someone else the right to permanently register in your apartment, and now that’s it — you can’t write this person out or evict him. Even in court. This is especially impossible to do if we are talking about former spouses or those who do not have their own housing.

How really

In reality, of course, there are two ways to do this:

  • At your request, the person himself is removed from the register.
  • A person is discharged by the registration authorities, based on a court decision. The second option is relevant for cases where the person being discharged refuses to do so voluntarily.

Registration gives only the right to reside. All other rights are with the owner of the property.

Myth 2. You can not sell an apartment in which minors are registered

If you have registered minors in the apartment, then you will have to wait with the sale of housing until those 18 years old. Even in extreme cases, no one will make an exception for you and will not approve the transaction.

How really

In reality, the situation is as follows: if a minor is registered in the apartment, the owner can sell the property in the usual way, no additional documents or permits will be needed. The main thing is that the child after that be registered at the new place of residence.

But if a minor has ownership of the property being sold, then first you need to get the consent of the guardianship authorities (and this is not something out of the ordinary) and only then engage in a sale and purchase transaction.

Myth 3. You can register in an apartment via the Internet without the participation of the owner

There are rumors that an outsider can now register in the apartment without your knowledge. And all because of the simplification of the registration procedure at the place of residence on the basis of the Decree of the Government of the Russian Federation of February 5, 2016. I rented an apartment, and once in it — and registered via the Internet.

How really

Yes, it is no longer necessary to go to the registration authorities to apply for a residence permit. But no one canceled the application from the owner of the housing in the package of documents. If the owner of the apartment did not write it, no one in his apartment will be able to register. No matter how you submit your documents.

Myth 4. To register, you have to pay a state fee

You heard somewhere that you need to pay a state duty for registration — 1% of the minimum wage. And from another friend, the owner asked for a state duty of 3,000 for registration of temporary registration in a rented apartment.

How really

A few years ago, the state duty for registration was canceled, and now it is not charged to citizens of the Russian Federation. It doesn’t matter if it’s permanent or temporary. You can sign up for free. If you are convinced that you need to pay for registration, remember: this is a scammer.

But for foreign citizens, this service is really paid — the state duty is 350 rubles. A foreigner must register within a month after arriving in Russia. If this is not done within 30 days, then he can be fined or deported.

Myth 5. You must register in your apartment

You have purchased a new home. Now, without wasting time, you need to go and register in it. Otherwise, you will have to pay a huge fine for violating the deadlines.

How really

Registration and ownership have nothing to do with each other. A person can own several apartments at once, but he can register only in one of them or even in another at all (with his parents, for example).

The right to a residence permit in their own housing does not oblige the owner of the apartment to anything. The main thing is that his place of residence was generally determined.
