Fall 2023 will bring several new rules for apartment building residents. Analysis of three new laws that come into force on September 1, in the material of the portal Legal subtleties.
1. The rules for using gas are changing
From September 1, a number of serious amendments to the rules for the maintenance (TO) of gas equipment in residential premises come into force (Decree of the Government of the Russian Federation on May 29, 2023 No. 859).
By the end of this year, owners and tenants of apartments will need to renew the contract for the maintenance of in-house gas equipment in accordance with the new rules (the main of which is that only one specialized organization can provide maintenance services for in-house and in-house gas equipment).
A contract for the maintenance of in-house gas equipment can be concluded by a managing organization on behalf of all owners of the premises of an apartment building, if they make an appropriate decision at a general meeting.
Otherwise, each owner (tenant) will need to renegotiate the contract on their own.
Under the new rules, the gas supplier may require its subscriber to provide a copy of the current agreement for the maintenance of in-house gas equipment — in its absence, she has the right to suspend the gas supply to the dwelling.
Managing organizations are obliged to check the condition of smoke and ventilation ducts in the houses under their jurisdiction at least 3 times a year — the relevant work is included in the Minimum List of Services and Works for the Maintenance of Common Property (approved by Decree of the Government of the Russian Federation of April 3, 2013 No. 290) .
Control over the activities of managing organizations is carried out by the bodies of the state housing inspectorate — therefore, you can file a complaint there with a complaint about your managing organization if it does not fulfill its duties properly.

2. A new procedure for coordinating changes made to the architectural and urban design of the house is being introduced
From September, the requirements for the appearance of capital construction facilities and the rules for its approval come into force (Decree of the Government of the Russian Federation of May 29, 2023 No. 857).
The authorized body, with which it is necessary to coordinate all changes that are made to the approved architectural and urban design of the house, is the local government.
This confirms that the owner of the apartment is obliged to coordinate any work aimed at changing the facade of the house (the color of the window frames, the bars on the windows, the installation of an air conditioner, a satellite dish, etc.), not only with the managing organization, but also with the municipal administration.
The new rules make an exception for Moscow, St. Petersburg and Sevastopol: these cities can set their own requirements for the appearance of buildings and structures.
3. The rules for providing new housing to those in need are being supplemented
According to the current rules, citizens who are registered as needing housing should be provided with housing under a social rental agreement within the boundaries of the same locality in which their place of residence was located (part 5 of article 57 of the LC RF).
From September 1, this norm is supplemented with the following phrase: with the written consent of citizens, the local government may provide them with housing in another locality, but on the territory of the same municipality.
That is, citizens have the opportunity to choose whether to stay in the same locality or move (Federal Law of July 24, 2023 No. 365-FZ).
