The Government Commission on Legislative Activities considered an initiative that allows maternity capital to be used for the reconstruction of houses in blocked buildings. We are talking about situations where the family owns part of the house.
The prepared bill is aimed at implementing the legal positions of the Constitutional Court of Russia. It is proposed to allow the use of maternity capital funds for the reconstruction of a house in a block building, as well as another capital construction facility in which a residential building with a separate entrance is located— quotes Russian newspaper Chairman of the Board of the Association of Lawyers of Russia Vladimir Gruzdev.
He recalled that, according to the current standards, citizens living in houses of blocked development — two-apartment, three-apartment, etc. — do not have the opportunity to use maternity capital funds to improve their living conditions.
The Head of the Board of the AJUR also stressed that block-built residential buildings do not fall under the definition of «individual housing construction.»
The Constitutional Court held that such a provision was inconsistent with the Basic Law.
“Currently, taking into account the development infrastructure of rural settlements in our country, there is an urgent need to make appropriate changes to the law. The proposed norms will make it possible to use maternity capital funds for the construction, reconstruction of not only individual housing construction projects, but also residential buildings in blocked buildings. Including families will be able to increase the living space of such houses due to the reconstruction permitted by law,” summed up Vladimir Gruzdev.
Maternity capital is 587 thousand rubles for the first child and 775.6 thousand rubles for the second.
