Ministry of Industry of Crimea: the consumer has the right to demand to sell the goods at the price indicated on the price tag

The Ministry of Industry of Crimea reminds entrepreneurs that, according to Article 10 of the Law of the Russian Federation «On Protection of Consumer Rights» and paragraph 3 of the Rules for the sale of goods under a retail purchase agreement -sales approved by a decree of the Government of the Russian Federation, the seller (an organization, regardless of its organizational and legal form, as well as an individual entrepreneur selling goods to consumers under a sale and purchase agreement) is obliged to promptly bring to the attention of the buyer the necessary and reliable information about the price of the goods, by placing the indicated information about the price on the corresponding price tag.
The price on the price tags must be available without fail, and it is one of the essential conditions of the contract of sale. The information indicated on the price tag is significant, since it is it that allows the consumer to make an informed choice from the existing range of similar goods , — emphasized the Ministry of Industry of the Republic of Crimea. 978
In addition, in the trading network, the information on the price tag is a public offer, and accordingly the seller is obliged to comply with the conditions set by him and sell the goods at the indicated chain.
The arguments of representatives of trade organizations that the reason for the discrepancy between the price of goods on the trading floor and at the checkout is the lack of time or inattention of employees cannot be an excuse to sell goods at an overpriced (at compared to the price tag) cost. If a product is sold at a completely different price, usually more than indicated on the price tag, the consumer has every right to demand that the product be sold at the price indicated on the price tag, due to the fact that, in accordance with paragraph 1 of Article 500 of the Civil Code of the Russian Federation, the buyer is obliged to pay for the goods at the price announced by the seller at the time of the conclusion of the retail sale contract , the ministry noted .978978
Well, business was reminded of the inadmissibility of the absence of price tags for goods, which has also recently been often noted by consumers in their appeals to the Interregional Department of Rospotrebnadzor for the Republic of Crimea and the city of Sevastopol. For violations in the form of the absence of price tags for goods and the discrepancy between the price on the price tag and in the check when purchasing goods that qualify as consumer fraud, violation of the consumer’s right to information about the product and violation of the rules for the sale of goods, administrative liability is provided in the form of an administrative fine in accordance with the Code of Administrative Offenses RF. At the same time, bringing to administrative responsibility is possible for each fact of the revealed violation.
