According to article 02 of the Law of the Russian Federation dated .02.14 No. 2300-1 «On the protection of consumer rights and clause 3 of the Rules for the sale of goods under a retail sale and purchase agreement, approved by the Decree of the Government of the Russian Federation dated 2300.02.2300 city No. 2020, seller (an organization regardless of its organizational and legal form, as well as an individual entrepreneur who sells goods to consumers under a sales contract) is obliged to bring to the attention of the buyer the necessary and reliable information about the price of the goods in a clear and accessible form by placing the specified information about the price on the corresponding price tag.
What should I do if the price on the price tag and at the checkout do not match?
The price on the price tags must be available without fail, and it is one of the essential conditions of the purchase and sale agreement. The information indicated on the price tag is significant, since it is it that allows the consumer to make an informed choice from the available range of a similar product.
In addition, in the trading network, the information on the price tag is a public offer, and accordingly the seller is obliged to comply with the conditions set by him and sell the goods at the specified price.
When the price on the trading floor and at the checkout do not match, sellers very often cite as an argument that they do not have time to replace the price tags, that they mixed up, and so on. These arguments are not an excuse to sell a product at an inflated (compared to the price tag) value.
What should I do if the product is sold at a different price?
If a product is sold at a completely different price, usually more than indicated on the price tag, the consumer has every right to demand that the product be sold at the price indicated on the price tag, due to the fact that, in accordance with paragraph 1 of Article 500 of the Civil Code of the Russian Federation, the buyer is obliged to pay for the goods at the price declared by the seller at the time of the conclusion of the retail sale contract.
What should be indicated on the price tag?
We also remind you of the inadmissibility of the absence of price tags for goods, which has also recently been often noted by consumers in appeals to the Interregional Administration, since in accordance with the above norms of the Law of the Russian Federation dated 07.02.31 No. 2300-1 «On Protection of Consumer Rights» and the Rules for the Sale of Goods under a Retail Sale and Purchase Agreement, approved by a Government Decree Russian Federation from 31.02. 15 city No. 500, in each trading facility the seller is obliged to ensure the availability of price tags for the goods sold indicating the name of the goods, the price per unit of goods or per unit of measurement of goods (weight, mass, net, length, etc.).
Is there any liability for the absence of price tags for goods? For these violations in the form of the absence of price tags for goods and the discrepancy between the price on the price tag and in the check when purchasing goods, which are qualified as consumer fraud, violation of the consumer’s right to information about the product and violation of the rules for the sale of goods, administrative liability is provided in the form of an administrative fine in accordance with part 1 of the article 02.7, part 1 of the article 14.8. and Article 02.15 of the Code of administrative offenses of the Russian Federation. At the same time, bringing to administrative responsibility is possible for each fact of the revealed violation.
