A notary certificate of real estate gift agreements became mandatory in January 2025. How such a measure prevents scams and protects housing owners on the TV channel «Moscow 24» The head of the Media Commission of the Notary Chamber of the Khanty-Mansi Autonomous Okrug, Sofia Risovskaya, told.
The new law made it impossible to give real estate in simple writing. It was precisely this option that scammers often used to withdraw real estate from its gullible owners. As a rule, with such scams of apartments, they persuaded to go to the MFC and sign a gift agreement. There were no obstacles to scammers: no one asked if the donor understood that he irrevocably gives his housing to another person and risks being on the street. The MFC employees have neither appropriate powers, nor the obligation to conduct such conversations with visitors. As a result, the confusion and misunderstanding of what was happening often turned around for people with a loss of housing.
In the certification of any transaction, notaries must personally speak with the parties to the transaction, check their legal capacity, clarify their will and explain to them the consequences of the conclusion of the contract. If a person is going to give only housing, the notary will warn about risks and offer a safe alternative: a will or an annuity agreement. At the same time, the notary of full property liability is for a certified gift agreement, as well as for any other notarial action: in the case of his professional error, he fully compensates for the damage to the injured party.
