Neighborly showdown: hit with a garden hoe led to the dock

The Leninsky District Court of the Republic of Crimea passed a sentence against a 63-year-old resident of the village. Battle of the Leninsky district for committing intentional infliction of moderate bodily harm.
During the judicial investigation, it was established that on May 10 of this year, at about 10 am, the defendant was near her house on the site and cleaned the grass in the front garden, at the same time she saw a neighbor nearby, with whom she had not developed friendly relations for a long time. In addition, the night before, that is, on May 9, a young man came to a neighbor in the evening, with whom she rested and listened to music loudly. That evening, the woman did not dare to make a remark to her negligent neighbor. However, in the morning, having met her near the house, a verbal conflict ensued between the women with reproaches for too noisy rest, during which the woman could no longer restrain herself, and, grabbing the hoe, hit her neighbor with it. The blow fell on the right hand in the region of the ulna— reported the details of the case in the press service of the court.
So, from a blow with a hoe, the victim received a fracture of the diaphysis of the right ulna.
At the hearing, the defendant fully admitted her guilt and repented.
The court qualified the defendant’s actions as deliberate infliction of moderate harm to the health of a non-life-threatening person, which caused a long-term health disorder or a significant permanent loss of general ability to work by less than one third with the use of items used as weapons (clause «h» part 2 of Art. 112 of the Criminal Code of the Russian Federation).
The court, having comprehensively studied the materials of the case, taking into account the circumstances of the commission of the crime, information about the identity of the defendant, imposed a sentence of imprisonment for a period of one year six months, conditionally with a probationary period of one year six months.
The verdict did not enter into force.
