Notary: help for defenders of the Fatherland

Immediately after the start of the Special Military Operation, the notary community initiated active work to provide assistance to military personnel, members of their families, as well as internally displaced persons. The total amount of benefits provided by notaries for refugees and mobilized citizens in the fall of 2023 exceeded 350 million rubles. Like all socially significant notary projects, the initiative with the provision of benefits is being implemented exclusively at the expense of notaries, without attracting budget money.
Already in February 2022, the Federal Chamber of Notaries (FNC) introduced support measures for refugees, and with the beginning of partial mobilization, a system of benefits was launched for those who went to the front. A year ago, additional support measures were also introduced for military personnel and their families. Subsequently, these decisions were reflected in the order of the Ministry of Justice of Russia No. 253 of September 12, 2023, which established a list of benefits for the above circle of persons.
What benefits can SVO participants receive?
Persons called up for military service as part of partial mobilization are completely exempt from paying the regional tariff for certification of powers of attorney, various consents and expressions of will, as well as wills.
Military personnel who have been injured and are being treated in hospitals and other military medical institutions are exempt from paying the regional tariff for three types of notarial acts. This is a certification of the equivalence of an electronic document to a document on paper, the transfer of electronic or paper documents to individuals and legal entities (with the exception of transfer in person against signature), as well as certification of the accuracy of copies of identity documents. This set of actions may be required, for example, to submit applications for certain government services, insurance compensation, as well as to resolve other pressing legal issues.
Benefits are also provided for spouses, parents and minor children of SVO participants who died while performing military service duties (service in the troops, agencies and institutions). They do not need to pay the regional tariff when certifying powers of attorney (with the exception of powers of attorney in the order of reassignment) and consents for the travel of minor children abroad, for them to obtain a foreign passport and a driver’s license. Also among the preferential notarial actions is certification of the accuracy of copies of identity documents and documents on state registration of acts of civil status of specified persons (one copy for each document).
In addition, family members of SVO participants and any other citizens are not charged a regional tariff when issuing certificates of inheritance rights when inheriting the property of deceased defenders. Including those who died within one year due to injuries (concussion) and illnesses.
In the cases listed above, we are talking about military personnel, including those under contract, volunteers, employees of internal affairs bodies, federal executive authorities and federal government bodies involved in a special military operation in the territories of the DPR, LPR, Zaporozhye, Kherson regions and Ukraine.
Notary chambers of the constituent entities of the Russian Federation supplement the federal support measures with their own initiatives.
Other forms of assistance
In addition to receiving services in their offices, notaries personally visit the wounded in hospitals, organize legal advice for their family members, and participate in events held by volunteer groups.
The Federal Notary Chamber also receives requests from citizens participating in the SVO and members of their families. These requests are given special attention and measures are taken to consider them as quickly as possible, with the involvement of specific regional notary chambers to resolve issues locally.
An important step in the multi-level system of support for SVO participants was the interaction between the notary office and the Defenders of the Fatherland state fund. The FNP entered into a cooperation agreement with the State Fund for Support of Participants in a Special Military Operation, and the notary chambers of the constituent entities of the Russian Federation entered into such agreements with the regional branches of the fund throughout the country. The goal is to improve the mechanism for providing legal assistance to SVO participants and legal information to veterans and members of their families.
Legal assistance provided by notaries throughout the country was almost immediately combined with charitable assistance. Notary representatives are in direct contact with those who are fighting on the front line. This includes traveling to the NWO zone to personally deliver collected cargo, obtain first-hand information about what is needed, and promptly respond to requests. The total amount of charitable assistance provided by the notary community is about 100 million rubles.
The contribution of notaries to helping SVO participants has been repeatedly noted by government bodies: territorial departments of the Ministry of Justice of the Russian Federation, heads, representatives of the government and legislative assemblies of regions and others. Also, words of gratitude come from public, medical and charitable organizations, command of military units and ordinary military personnel.
