Official: The Federation Council approved the abolition of real estate duties for the heirs of SVO participants

At the meeting, the Federation Council approved a law exempting from payment of state duty for registering ownership rights in Rosreestr for inherited real estate of military personnel. This measure applies to the heirs of those killed or died before the expiration of one year after the dismissal from service of military personnel, employees of internal affairs bodies or the National Guard, as well as those killed as a result of injury (wounds, trauma, concussion) received as a result of shelling, explosions or destruction by armed forces. formations of Ukraine and (or) terrorist acts.

The bill, initiated by a group of deputies and senators, makes appropriate amendments to the Tax Code of the Russian Federation, explains TASS.

According to the document, this category of heirs is exempt from paying the state duty for registration with the Rosreestr authorities of the transaction of transfer of ownership of the testator’s real estate to the heirs on the basis of certificates of the right to inheritance.

Currently, when registering an inheritance, heirs incur expenses for notary services, as well as when registering the transfer of ownership of real estate from the testator to the heirs. The cost of paying the state duty in Rosreestr is 2 thousand rubles for each transaction.

Currently, the current legislation provides for the release of the heirs of testators — employees of internal affairs bodies, persons who served in the troops of the National Guard of the Russian Federation and had special ranks of police, military personnel of the National Guard troops, military personnel of the Russian Armed Forces who died in service or died before the expiration of one year from the date of dismissal from services due to injury (concussion) or illness, from payment of notary services when registering an inheritance.

For the second reading of the document, State Duma Chairman Vyacheslav Volodin and deputies introduced an amendment, according to which relatives of citizens who died from shelling from Ukraine and as a result of terrorist attacks will also be exempt from paying state fees for performing notarial acts when issuing a certificate of inheritance.

After the adoption of the law, family members of deceased SVO participants will also be exempt from paying fees when registering ownership rights to inherited real estate in Rosreestr.

Now, when registering such real estate, relatives of a deceased soldier are only exempt from paying for notary services,” the Chairman of the State Duma noted earlier.

The provisions of the bill will also apply to relatives of those participants in the special operation who died within a year after dismissal caused by injury or shell shock.

According to the adopted amendments, the state duty is not paid in the case of issuing a passport of a citizen of the Russian Federation to citizens of Ukraine and stateless persons who have, as a document confirming the right to stay in the Russian Federation, a temporary residence permit for the purpose of obtaining education, as well as incapacitated persons who are persons without citizenship permanently residing on the territory of Ukraine. Such persons will not pay a state fee for admission to Russian citizenship; they are also entitled to benefits when applying for certain notarial acts.

The law will come into force on the date of official publication.
