Officially: a notarial real estate gift agreement to a close relative became more accessible

Amendments to the Tax Code of the Russian Federation, which expand the list of notaries for citizens, entered into force. The relevant law was signed by the President of the Russian Federation and published.
Now, when certified by real estate donation agreements in favor of family members and close relatives, 50% benefits are granted to pay for the federal tariff. We are talking about spouses, parents, children, grandparents, grandchildren, brothers and sisters.
Recall that in January 2025 a mandatory notarial form of real estate gift agreements between citizens was introduced. The list also includes transactions between close relatives. As practice shows, special confidence in the family member often makes the donor even more vulnerable, less vigilant and careful. Unscrupulous relatives can use this situation for selfish purposes.
The federal tariff for transactions subject to compulsory notarization is 0.5% of the contract amount and cannot exceed 20,000 rubles. This tariff is one for all constituent entities of the Russian Federation. Plus, a regional tariff is paid for this, which is set separately in each region. For example, for close relatives in Moscow in 2025, it is 7,000 rubles.
As a result, giving a close relative of even the most expensive metropolitan real estate will cost a person no more than 17,000 rubles: 10,000 federal tariff (taking into account the benefits of 50%) and 7,000 — regional.
When certifying the gift agreement, the notary publics a wide range of checks: from establishing the personality of participants and checking documents to requests to the registry office, the Ministry of Internal Affairs and other departments and state bases.
The notary will also ensure the verification of the legal capacity of the parties, find out their true intentions and explain all the legal consequences, which will significantly increase the protection of property rights of the donor. The participation of a notary will not allow the owner to mislead and illegally take up his housing. This excludes the risks of signing a transaction under pressure or in an inadequate state.
Note that today the notary provides a wide list of benefits to the most diverse categories of citizens. The alienation of real estate is included in the TOP-3 of the most popular «preferential» notarial actions.
In the certificate of various real estate transactions, minors, veterans and disabilities of the Second World War, former prisoners of war during the Second World War, prisoners of fascist concentration camps, heroes of the Soviet Union and the Russian Federation, full cavaliers of the Order of Glory, disabled people and II groups, disabled people from childhood and others can save.
There are also benefits for citizens when improving housing conditions and alienation of real estate from the emergency fund. A number of benefits are provided for in the framework of the registration of inheritance rights, including real estate.

It is fundamentally that notaries provide legal guarantees and always bear full property responsibility for the result of their work, even if they perform notarial actions for free or taking into account the benefits.
