Possible innovation: Persian operators may prohibit collecting customer profiles

Operators of personal data of citizens (PD) may prohibit collecting customer profiles, in other words, automatically process PDs in order to analyze personality and predict the interests, preferences and behavior of people without a separate consent. This means that commercial banks, telecom operators, marketplaces will not be able to collect data from different sources without the knowledge of customers. Such a measure is provided for by a new bill on counteracting fraud, which was prepared by the Minzifra in pursuance of the order of Deputy Prime Minister Dmitry Grigorenko, writes Vedomosti.
The document proposes to prohibit the analysis and forecasting of characteristics regarding the economic position of the subject of the PD, its state of health, personal preferences, interests, behavior and location with the help of any automated algorithms. These edits will be made in Art. 5 No. 152-ФЗ “On Personal Data”, which determines the basic principles of processing of Persian.
The subjects of the Persdani themselves will be able to direct consent to data processing only through two channels — directly to the operator or through ESIA (a single identification and authentication system). In the same way, it will be possible to withdraw consent. When collecting personal data through any channels, the PD operator will have to transfer information about the fact of processing information in Esa, the bill said.
Now the “second package” of measures to combat fraudsters is under interagency agreement and may change taking into account the proposals of departments and industry, the representative of the apparatus Grigorenko said.
The adoption of a bill restricting the automated collection and analysis of personal data without the separate consent of citizens is an important step towards strengthening digital security and protecting the rights of personality in the context of the rapid development of algorithmic technologies, according to the State Duma Committee on Information Policy, Information Technologies and Communications, the federal coordinator of the Digital Russia party project Anton Nemkin.
Today, personal data is no longer just a phone name and phone number, but a full digital dossier that allows you to predict the behavior, financial situation of a person. Such information becomes a valuable resource not only for legal business, but also for criminal schemes based on social engineering. Therefore, the intensification of regulation here is absolutely justified— said the deputy.
The key challenge will be the implementation of technological and legal integration with ESIA. On the one hand, this is a step towards centralized control over data, which can increase the transparency and accountability of operators. On the other hand, there is a risk of excessive bureaucratization of the processes of obtaining and recalling consent, which will reduce the flexibility of the services and worsen user experience.
It is necessary to ensure that this mechanism does not become an additional administrative barrier, especially for companies from regions and bearing limited personnel and technical resources— added Nemkin.
In general, the ban on profiling should not be an end in itself, but part of a comprehensive strategy to combat fraud.
The limitation of algorithms in itself will not exclude crimes if the effective system of cyberoperative response, digital hygiene and infrastructure protection is not built in parallel. The main thing is to balance the interests of security and development so that Russia remains a digital sovereign state, but does not lose the rate of technological growth, ”the parliamentarian concluded.
