Prospect: in Russia, the state fee for going to court will increase several times
CrimeaPRESS reports:
The State Duma Committee on Budget and Taxes approved in the second reading the government bill on amendments to the Tax Code of the Russian Federation. This document, submitted to the Duma in March, proposes a significant increase in the amount of state fees for appeals to the courts.
According to the proposed changes, the cost of filing a bankruptcy petition in an arbitration court for individuals will increase from 300 to 10,000 rubles, and for legal entities from 6,000 to 100,000 rubles.
It is also planned to increase the fees for filing property claims. For example, for claims up to 100,000 rubles, the fee will be a fixed 10,000 rubles instead of the current 4% of the claim amount. For claims from 100,000 to 1 million rubles, the fee will consist of 10,000 rubles plus 5% of the amount exceeding 100,000 rubles.
Fees for filing appeals and cassation complaints for organizations will increase significantly. For example, the fee for an appeal will increase 10-fold to 30,000 rubles, and for a cassation complaint 16.5-fold to 50,000 rubles.
In addition, new fees are being introduced for various procedural applications, such as succession or issuance of writs of execution. Their amount will vary from 5,000 to 30,000 rubles.
Experts interviewed Forbesbelieve that the main purpose of increasing fees is to reduce the burden on the judicial system. According to lawyers, this could lead to increased efficiency of judges, who are currently heavily overloaded. For example, in Moscow arbitration, one judge can have up to 40 hearings per day.
