What legislative innovations in the real estate sector will come into force in the new year and how these changes will affect the market — in the material of the portal Novostroy.

Increase in maternity capital

From February 1, 2024, maternity capital will be indexed by 7.5% for those families who have not yet used the certificates or for whom part of the funds remains unused. The payment for the first child will increase from 587 to 631 thousand rubles, and for the second – from 776 to 834 thousand rubles.

Tax changes

In 2024, the transition to a single tax account (STA) will be final.

The Unified Tax Service is a single tax wallet through which all tax payments and contributions will be made. This will lead to greater transparency, including for the short-term rental segment, since it will become more difficult to evade taxes, – explained the deputy head of the legal department of the real estate agency “Etazhi” Elen Lukyanova.

The expert also reminded that from January 1 again introduced VAT on developer services when transferring apartments that were built and sold under shared construction agreements. “This rule was repealed in 2010, but now it is back. This will be reflected in the final cost of the apartments — demand will shift towards the purchase of real estate with the status of residential real estate.”

Electronic registration of transactions with legal entities

From January 1, 2024, Rosreestr will completely switch to electronic registration of real estate transactions with legal entities.

It will become easier for individuals to submit documents: they will need a scan of the contract, but documents for the objects will not be needed, – noted Elen Lukyanova.

Time frame for major repairs

From September 1, 2024, the timing of major repairs of apartment buildings will be calculated differently, depending on the degree of their deterioration.

Owners will be able to initiate a study of the building themselves to speed up the start of work. This will be relevant for those houses that urgently need renovation, but it is planned only in a few years, – says Elen Lukyanova.

Changes in borrower insurance

On September 1, 2023, government decree No. 39 of January 18, 2023 came into force, which simplified for borrowers not only the choice of an insurance company when applying for a loan (including a mortgage), but also the verification of the client by the bank.

The resolution will be valid until September 1, 2025, – follows from the words of Elen Lukyanova. – This will entail a reduction in the average insurance rate: insurers will try to retain existing clients and attract new ones.

Other innovations

In addition, from February 1, 2024, the law “On Amendments to the Federal Law “On Consumer Credit (Loan)” and certain legislative acts of the Russian Federation comes into force.” According to this document, the “cooling period” for insuring consumer loans has been increased. “With the innovation, you can cancel this type of insurance within 30 days, and not 14 days, as before. Moreover, it will be possible not only to cancel the contract, but also to return the insurance premium (or part of it),” – Helen Lukyanova drew attention.

To the above, Managing Partner Prime Life Development Denis Konovalenko adds that starting from the new year, developers will have to submit to the rights registration authority an application for state registration of rights (GRP) of ownership of participants in shared construction for premises and parking spaces.

At the same time, the rules for calculating land tax are adjusted.

The procedure for determining the tax base of part of the land has been established, and the conditions for terminating the application of the increasing coefficient when calculating tax in the case of hydraulic fracturing have been changed., – Denis Konovalenko comments. – In addition, we expect the order of the Ministry of Agriculture of the Russian Federation “On approval of the form and procedure for maintaining household books” to come into force — they will be maintained in electronic form.

An important point, according to the developer, will be that the FGIS “EDS NSPD” (federal state information system “Unified Digital Platform “National Spatial Data System”) in 2024 will ensure the maintenance of a data fund for state cadastral valuation and monitoring of its implementation.

It also becomes possible to establish the boundaries of settlements and territorial zones if there is an intersection with the boundaries of land plots, – says Denis Konovalenko. – Additionally, it is worth noting that land plots with agroforestry plantations, which are in state or municipal ownership, will be leased without bidding.

The procedure for redevelopment of premises has also been improved. “It has been established from what point the planning is considered completed, and a list of necessary documents has been indicated. Afterwards it will be necessary to make changes to the Unified State Register or carry out state cadastral registration,” – follows from the words of Denis Konovalenko.

Innovations for tenants and landlords

In addition, Oksana Vasilyeva, Candidate of Legal Sciences, Associate Professor of the Department of Legal Regulation of Economic Activities of the Financial University under the Government of the Russian Federation, notes that in 2024 a number of changes are expected in Russian housing legislation designed to make the housing rental system more transparent, fair and safe for all participants. In the list of changes, according to Oksana Vasilyeva:

  • increasing the minimum lease term for public housing to 15 years to provide greater stability and security for public housing tenants and reduce the risk of fraud by landlords;
  • mandatory registration of rental agreements on the official websites of government bodies (these innovations are aimed at creating a transparent housing rental system to avoid fraud and ensure the protection of tenants’ rights);
  • creation of a unified database on available residential premises (will help ensure that information on available residential premises is available to everyone);
  • establishing minimum and maximum rental rates for various types of housing (the law is intended to establish fair prices for rental housing and protect tenants from overpayments);
  • introduction of compulsory housing insurance against natural disasters and fires to ensure protection of tenants from financial losses in the event of natural disasters or fires;
  • tightening requirements for the quality of housing for rent (will help improve the quality of housing available for rent and protect the rights of tenants);
  • expanding the rights of tenants to participate in decisions about the repair and maintenance of housing (will give tenants more control over their rental housing and help improve its condition);
  • strengthening control over compliance with the rights of tenants and protecting them from fraud (the law has strengthened and measures to protect the rights of tenants and combat fraud);
  • clarification of the procedure for providing social housing to low-income citizens (the law will clarify the rules for providing social housing and will help protect the rights of low-income citizens);
  • determining the procedure for the use of commercial space in residential buildings (the law will establish rules for the use of commercial space in residential buildings to ensure the safety and comfort of residents).

While legislative initiatives

Novostroy’s interlocutors also spoke about what else to expect from next year. Thus, at the level of legislative initiatives, Ellen Lukyanova noted:

  • “The maternity capital program can be made indefinite;
  • the future fate of the preferential mortgage is being decided;
  • guarantees are being discussed for owners of housing that is located on a site for integrated development of territories and is subject to demolition;
  • a bill on the use of the escrow account mechanism in the construction of private houses (IHC) is being considered;
  • “Perhaps they will cancel commissions when paying for housing and communal services.”
