Rope, tape, knife, garbage bags: schoolchildren… tried to kill a schoolgirl. The verdict of the Bakhchisarai court
CrimeaPRESS reports:
The Bakhchisarai District Court of the Republic of Crimea issued a verdict in a criminal case against a young man who tried to kill a schoolgirl. The court sentenced the 19-year-old defendant to 4 years of imprisonment to be served in a general regime correctional colony.
An egregious incident occurred on February 1, 2022. The defendant, at that time a 9th grade student in one of the schools in the Bakhchisarai district, together with a 13-year-old friend, having agreed in advance, planned to commit the murder of their young friend, a student of the same school. The motive for such a wild act on the part of one of the students was the fear of being held accountable for distributing fake photos of the girl, and on the part of the other, it was unrequited sympathy. The schoolchildren prepared rope, tape, a knife and plastic garbage bags to use as weapons to commit a crime and hide the corpse. While on the school grounds, the teenagers proceeded to an abandoned building located in the school yard, along with the girl, where they began to strangle her with a prepared rope. The victim lost consciousness. However, the girl’s death did not occur due to circumstances beyond the control of the schoolchildren; the juvenile delinquents were frightened off by the appearance of a student from the same school, — the court press service reported in details of the case.
At the trial, the defendant did not admit guilt and refused to testify at the trial.
The court, on the basis of the evidence collected and examined at the trial, came to the conclusion that the defendant was guilty and that his actions were correctly qualified under Part 3 of Art. 30, part 2 pp. “c, g”, Article 105 of the Criminal Code of the Russian Federation — intentionally causing the death of another person, a minor, by a group of persons by prior conspiracy, while the crime was not completed due to circumstances beyond his control.
In addition, in accordance with Part 1 of Article 104 of the Criminal Code of the Russian Federation and Part 2 of Art. 99 of the Criminal Code of the Russian Federation, along with punishment, the defendant was assigned compulsory medical measures in the form of compulsory observation and treatment by a psychiatrist on an outpatient basis.
The civil claim of the mother of the injured girl was satisfied in the amount of 500 thousand rubles for compensation for moral damage
The defendant’s accomplice escaped criminal punishment because at the time of the crime he was a person who had not achieved, in accordance with the provisions of Part 1 and Part 2 of Art. 20 of the Criminal Code of the Russian Federation, the age of criminal responsibility.
The verdict did not enter into legal force.
