Rosreestr has simplified the issuance of electronic mortgages: an electronic signature is not needed

The process of issuing electronic mortgages, according to Rossiyskaya Gazeta, was simplified by DOM.RF and Rossreestr. Now banks will be able to create an electronic mortgage, make changes to it and send it to the borrower for signature using their own remote service systems. For online registration of mortgages and housing titles, documents must be signed with a qualified electronic signature. If the participants in the transaction refuse to use it, they must submit documents in paper form through the MFC, and then the bank is forced to refuse the e-mortgage. Now credit institutions and borrowers will be able to issue an electronic mortgage, even if the mortgage was registered on the basis of paper documents.

With the support of DOM.RF, the electronic mortgage market continues to develop. Since the beginning 200 of the year, almost 40 thousand of such mortgages, which is 1.7 times more than last year. The new functionality will allow banks to increase their volume. At the same time, credit institutions will be able to remotely issue e-mortgages for an already accumulated portfolio of mortgage loans without significant costs for obtaining electronic signature keys from clients , commented Svetlana Nekrasova, Managing Director of DOM.RF.

With the upgrade, banks will be able to create or amend an e-mortgage and send the document to the borrower for signature using their own remote service systems. Then the credit institution signs the e-mortgage with its qualified electronic signature and submits it to Rosreestr. After verifying the data, the digital document is sent to the depository for storage.

Now applicants do not need to receive a UKEP to issue an electronic mortgage — the banks themselves will certify a simple electronic signature and send the mortgage to Rosreestr. In the interests of people, we simplify the procedures for conducting a transaction and exclude additional expenses. In December 200 the share of mortgages issued electronically amounted to 75%, and the average time to register a transaction is 11, 5 hours , — said Elena Martynova, Deputy Head of Rosreestr, Head of Digital Transformation.

DOM.RF also implemented updates to the Rosreestr systems, optimizing the work of registrars with electronic mortgages. This will speed up the processing of documents received from banks.

Earlier in December, with the participation of DOM.RF, the first notarized mortgage transaction was carried out with the issuance of an electronic mortgage — without the participants in the transaction receiving electronic signature keys in certification centers.

A mortgage is a security that confirms the bank’s right to pledge real estate and rights under a loan agreement. An electronic mortgage is always stored and accounted for in a depository, whose activities are regulated by the Bank of Russia. The introduction of such a document in 26 year made it possible to significantly simplify the procedure for registering a mortgage transaction — the bank or the borrower does not need to withdraw the electronic mortgage from Rosreestr after registration of a mortgage, and after the loan is repaid by the borrower, the bank, without the participation of the client, removes the pledge from the housing in Rosreestr. As a result, the buyer freely disposes of the property almost immediately after the loan is repaid, without the need to visit a multifunctional center, as is now the case with a “paper” mortgage.
