With the onset of summer, many Russians are in a hurry to their suburban areas. A cozy cottage is not only a place of rest, but also a space for work and implementing various projects. However, the question often arises: what outbuildings should be registered in the Rosreestr, and which ones — no? We will figure it out in detail in this matter.
What relates to household buildings?
Economic (auxiliary) buildings include structures located on the land plot and designed to maintain the main building (residential building, garden house) or performing auxiliary functions. These include:
- sheds and pantries (for storing equipment, instruments and crops),
- Bans,
- greenhouses and greenhouses (for plant growing),
- gazebos and canopies (designed for recreation in the fresh air),
- garages (for storing cars and other equipment),
- household blocks (combined structures combining several functions).
When is registration mandatory?
Not all outbuildings are subject to registration. Mandatory registration is required for objects recognized by real estate. Key criteria defining real estate:
- The presence of the foundation. The construction should have a strong foundation that provides stability and inextricable connection with the ground. Light structures on screw piles or temporary structures, as a rule, are not subject to registration. The depth of the foundation and its type play an important role.
- The inextricability of the connection with the Earth. Moving the construction without causing significant damage is impossible. This means that the construction is a monolithic structure, indifferent without damage. For example, a polycarbonate greenhouse on a light frame will not be considered real estate.
- Production material. The use of capital building materials (brick, concrete blocks, beams, special technologies of wooden housekeeping) indicates the capital of the structure. Clear designs made of light materials (for example, temporary sheds from boards) are usually not recorded.
- Dimensions and purpose. Although there are no specific sizes that determine the need for registration, large and capital buildings (for example, a large garage or workshop) will require registration.
Registration procedure
In advance registration will avoid unpleasant surprises and provide legal protection of your property rights.
- To register the owner, it is enough to contact the cadastral engineer who will determine the characteristics of the outbuilding (coordinates, area) and prepare a technical plan on the basis of a declaration of real estate.
- Further, to Rosreestr, it is necessary to transfer an application for state cadastral registration and registration of rights, as well as a technical plan prepared by a cadastral engineer.
- The owner can do this personally or authorizing the cadastral engineer by prescribing the relevant information in the contract for the implementation of cadastral work.
