The federal law regulating the seizure of unused land enters into force on March 1. At the same time, the Rossreestr denied reports that since the beginning of spring, owners who do not use the land for their intended purpose will begin to seize plots in a simplified manner. On the contrary, the owners will have more time to master the land.
Messages about the seizure of sites that appeared on the network are not true, the experts of Rosreestr emphasized. The legislation does not have a “simplified” procedure for the seizure of land, the department said.
The federal law, which comes into force on March 1, 2025, contains new mechanisms for protecting the rights of land owners. For the development of land plots in settlements, as well as garden and garden plots, is allocated for three years. The department clarified that the seizure of the land is discussed if the plot is cluttered, swampy, overgrown with weeds. To put the land in order and prepare it for use, is additionally given for three years. During this period, you can carry out all the work: drain the site, level the relief, clean it of garbage and weeds. According to the current legislation, the land can be removed if the owner could not master the plot in three years. But the new rules that will begin to operate in March, the term to the possible seizure of the site is increased to 5-7 years.
Within three years, while the owner is mastering the site, he cannot be held accountable for the misuse of land. After three years, you need to start using the site for its intended purpose. This can be the construction of the house, the cultivation of agricultural products, the construction of a recreational facility. From this moment, the owner of the site is responsible for the non -use of the Earth.
The grounds for the seizure of land will not be expanded, the Rosreestr emphasized. It is also not planned to increase fines for non -use of land.
