Round table: «Mandatory share in the inheritance.» The president of the notary chamber of the city participated from Sevastopol

Kutafina (MGUA) passed the All-Russian scientific and practical round table «Mandatory share in the inheritance: problems of legal regulation and law enforcement practice.» The event was organized by the Department of Notaries and the Department of Advocacy of the University named after O.E. Kutafina (MGUA), Federal Notary Chamber, Federal Chamber of Lawyers of the Russian Federation and the Center for Mediation at the RSPP.
Olga Kalenkovich, president of the notary chamber of the city of Sevastopol, took part in the format of video conferences in the event.

The legal regulation of the obligatory share in the inheritance is an important and acute issue, because, on the one hand, this institution plays a social role, that is, it provides support for unmarried heirs, and on the other hand, it limits the will of the testator to dispose of his property. Inheritance law is the traditional competence of notaries. It is actively developing, new institutions appear. We improve our skills, take measures to protect the rights of participants in hereditary legal relations. The problem of notary public participation in such matters as a mediator remains important.

During the planned discussion, we will reveal urgent legal problems that arise in the exercise of rights to a mandatory share, discuss the provision of qualified legal assistance to citizens and the role of alternative methods for resolving conflicts. The institution of compulsory inheritance is an important element of legislation that guarantees a fair balance between the social functions of the state and the will of the testator. State policy in the field of family protection and preservation of traditional family values is aimed at the formation of a society, where everyone feels responsibility for their relatives and friends.
During the event, the participants discussed the prospects for the legal regulation of the institution of the obligatory share in the inheritance, the features of the notarial registration of the rights of persons entitled to the obligatory share and the provision of legal assistance to them, as well as the possibility of applying mediation in resolving disputes related to the right to the obligatory share in the inheritance.
