Sevastopol Tax Service: notification of a controlled foreign company can be adjusted

Organizations and individuals who are residents of the Russian Federation are obliged to annually submit notifications of participation in foreign organizations (the establishment of foreign structures without forming a legal entity). Legal entities send notifications to the tax authority at the place of registration, individuals may submit notifications at the place of their account.

Despite the fact that the deadline for the provision of notifications has expired, the question remains relevant in what cases the reference to the reporting reports is provided.

An updated notice of participation in foreign organizations must be submitted:

• If the information is not fully reflected in the presented notification, as well as inaccuracies and errors in filling it out;
• There have been changes in information about a foreign organization (foreign structure without forming a legal entity), in respect of which a notification was previously filed;
• Information about a foreign organization has changed in connection with its redamination (i.e. the transition from one foreign jurisdiction to another).

The form, format and procedure for submitting a notification of the CIC in electronic form, approved By order of the Federal Tax Service of Russia dated 07/19/2021 No. ED-7-13/671@.

When filling out the specified notice, it is necessary to take into account the following recommendations. On the title sheet in the field “Foundation of the notification (code)”, code 6 is indicated. Along with the filling of sheet A “Information about a foreign organization” or sheet in “Information about a foreign structure without forming a legal entity”, those sheets of notifications are subject to the relevant information.
