Some categories of landowners can independently initiate a preventive visit to the state land inspector on their land. This was announced by the Deputy Chairman of the State Committee for State Registration and Cadastra of the Republic of Crimea, Deputy Chief State Public Practice for the use and protection of land, Konstantin Titkov.

At the end of last year, amendments to Federal Law No. 248-ФЗ “On State Control (Supervision) and Municipal Control in the Russian Federation” entered into force, according to which two types of preventive visits are established-a mandatory preventive visit and a professional information on the initiative of the controlled person.

A preventive visit, as can already be understood from the name of the event, is a preventive event to prevent (lead) violations of land legislation, including unintentionally committed by the land user, for example, due to ignorance of any legal aspects. The state instructor holds the corresponding visit at the place of activity of the controlled person or remotely-in the format of video conferences.

Mandatory professional certificates are carried out in relation to specific control objects depending on the risk category assigned to them and do not take into account the desire/reluctance of the subject of control to communicate with the representative of the authorities.

In the course of a mandatory preventive visit, the inspector can conduct an inspection, request the necessary documents, conduct the so -called instrumental examination or examination. If, according to the results of such a preventive visit, violations are identified and they are not eliminated until the end of the visit (usually up to 10 days), then the controlled person is issued an order to eliminate them.

In addition, it is possible to conduct a professional certificate at the initiative of the controlled person. At the same time, only small businesses, socially oriented non -profit organizations, as well as state or municipal institutions, are entitled to initiate the event. You can file an application for a preventive visit through the “State Services” portal. In this case, the requirements are not issued.

The innovation is the possibility, with the consent of the controlled person, the inspector of sampling (samples), instrumental examination, test. However, instructions for such visits cannot be issued.

The purpose of preventive visits is to explain to the owner the requirements of the current legislation so that it enjoys land without violating the law. That is why, within the framework of preventive measures as such, administrative sanctions are not applied. However, all the rules have their own exceptions. If, within the framework of the preventive visit, the state -owned inspector determines that the object poses a clear direct threat of harm (damage) to the values ​​protected by law, say, life and health of people, he will have to organize not a preventive, but a supervisory event, — notes Konstantin Titkov.
