SuperJob lawyer: how weekends will be arranged in 2024

The Ministry of Labor has published a draft resolution on the postponement of holidays in 2024. Alexander Yuzhalin, head of legal practice at SuperJob, told how this will “work”. According to this project, next year, employees working on a five-day work week will rest as follows:

  • from 1 to 8 January. Considering that in 2023 December 30 and 31 are Saturday and Sunday, the New Year holidays in 2024 will last a total of 10 days.
  • from 23 to 25 February (3 days);
  • from 8 to 10 March (3 days);
  • from April 28 to May 1 (4 days) and from May 9 to 12 (4 days);
  • 12 June;
  • from 3 to 4 November (2 days);
  • from 29 to 31 December (3 days with the transition to the New Year holidays of 2025).

At the same time, in order to extend the days off in some months, some Saturdays in 2024 will be working. So, working Saturdays will be April 27, November 2 and December 28.

Why are holidays set this way?

In Russia, a single list of non-working holidays has been established, which do not change from year to year. At the same time, the Government of the Russian Federation has the right to transfer «normal» days off to other days of the calendar (in order to rationally use the days off a year). Thus, days off coinciding with the New Year holidays are transferred to other days, and the Government may also set a working day on Saturday in order to transfer this day off to other calendar days (in order to extend the days off). All these «transfers» should be reflected in the Government Decree, which should be issued during 2023.

Given that the Decree of the Government of the Russian Federation will be adopted in this form, it is already possible to determine which months of 2024 will be the most beneficial for using vacation.

So, the most financially beneficial for an employee when planning a vacation will be:

  • July — 23 working days (and 184 hours);
  • October — 23 working days (and 184 hours);
  • August — 22 working days (and 176 hours);

The most unprofitable months, from this point of view, will be:

  • January — 17 working days (and 136 hours);
  • June — 19 working days (and 151 hours);
  • February — 20 working days (and 159 hours);
  • March — 20 working days (and 159 hours);
  • May — 20 working days (and 159 hours).

What is the logic behind determining profitable and unprofitable months? In short: the fewer working days in a month, the more unprofitable it is to take a vacation this month.

By law, the number of working days and days off in a month does not affect the wages of employees who receive a salary. But the cost of a working day in different months may vary. To determine the cost of one working day, you need to divide the monthly wage by the number of working days. Accordingly, the fewer working days in a month, the higher the cost of one working day. In months where there are few working days, it may not be profitable to go on vacation, since the cost of one working day may be higher than the average daily earnings (from which the vacation is calculated). And vice versa — the more working days in a month — the more profitable it is to use vacation in this month.

Given the planned production calendar of 2024, the most optimal month in which to take extra days off or use part of the vacation will be May. For example, if you take additional rest days on May 2 and 3, you can rest for 7 days (April 29 to May 5). Or, if you take rest days on May 6, 7 and 8, you can rest for 9 days (from May 4 to 12). If everything is combined, the total duration of the rest can be 14 days.

How can you get extra rest days?

1) If there are legal «days off». For example, an employee worked on a weekend or holiday and asked for another day of rest instead of an increased pay. The same will happen if the employee «earned» additional days off by working overtime;

2) If the employee is a donor and donates blood, the employee will also be entitled to an additional day off, which he can use at his discretion;

3) On these days, you can also take annual leave or leave without pay. But in both cases, you will have to negotiate with the employer. Leave without pay is granted in most cases with the consent of the employer. To take annual paid leave these days, you will have to divide the vacation into parts, which is also possible only with the consent of the employee and employer.

Although May in 2024 is not the most profitable month for using a vacation, nevertheless, this month can be considered, since the number of working days in May is not much less than the average month of 2024. Therefore, there may be a loss in the employee’s income, but it will be insignificant.
