The law introduces a ban on surgery and hormonal therapy for transgender transition, except in cases where medical intervention is necessary to treat congenital anomalies or malformations, genetic and endocrine diseases associated with a violation of the formation of genital organs in children. The change of sex in the documents will be allowed only on the basis of a medical report on the conformity of gender characteristics, issued by the medical commission of organizations subordinate to the Ministry of Health.

According to the amendments to the Family Code, the change of sex by one of the spouses will become the basis for the annulment of marriage, the Russians who have changed their sex will no longer be able to adopt a child or establish guardianship over him. The provisions of the law will not apply to citizens who, prior to its entry into force, made a transgender transition and received a conclusion from a medical commission on the conformity of gender characteristics.

After the State Duma accepted the law on the ban on gender reassignment in the third reading, speaker Vyacheslav Volodin, explaining the need for the initiative, referred to US statistics. “Think about it: there have been 50 times more gender reassignment surgeries in the US over the past 10 years — transgender people (according to 2022 data) 1.64 million, including 1.3 million adults (0.5% of the adult population) and 340,000 teenagers (1.4% of all US children aged 13-17),” he wrote on Telegram, calling it a path to the “degeneration of the nation” and emphasizing that “for us it is not admissible.» Volodin did not provide data on the number of adults and adolescents who changed their sex in Russia.

The bill on the ban on gender reassignment was developed, among other things, due to the increasing cases when gender reassignment certificates were used to evade military service for mobilization, wrote Kommersant, citing sources in the State Duma. The text of the bill cited statistics from the Ministry of Internal Affairs, according to which in 2022, 996 people applied for a replacement passport on the basis of “sex change”. In 2016, there were 142 of them. In total, from 2016 to 2022, 2,990 Russians decided to change their passport due to a sex change.

Lawyers and doctors spoke against the bill, suggesting that it be withdrawn from consideration. As a result of the round table at the site of the Independent Psychiatric Association, a critical review was prepared, which stated that the initiative to ban gender reassignment violates the right to life and medical care, and also “imposes an ideology”. The review noted that the draft law is aimed at discrimination and deprivation of access to medical care for people with a medical diagnosis of «transsexualism», is based on information that is not supported by a sufficient evidence base and does not contribute to the achievement of the stated goals. The executive director of the Independent Psychiatric Association of Russia, Lyubov Vinogradova, cited statistics according to which 0.5% of the population has been living with “true transgenderism” since childhood, and the mismatch between gender and sex has a serious stressful effect on them.
