The commission in Sevastopol considered more than eight thousand proposals for the draft rules for land use and development

In Sevastopol, public hearings on the draft rules for land use and development have been completed. The conclusion about their results is published on the website of the Government . According to Deputy Governor Nikolai Gordyushin, more than 8,000 comments and proposals on the project have been received from the residents of the city. A special commission chaired by vice-governor Nikolai Gordyushin reviewed them and made recommendations on almost every topic. It also included the heads of all specialized executive authorities, deputies of the Legislative Assembly, heads of municipalities, the Commissioner for Entrepreneurs’ Rights.

Of course, a lot of proposals have been received to change agricultural zones into residential zones or to include land plots for agricultural use in the boundaries of the integrated development of the territory. For such lands, a decision was made on the possibility of changing the territorial zone CX-1 to CX-2, but only if there are no other restrictions. For example, zones with special conditions for the use of territories, cultural heritage sites, specially protected natural areas. I draw your attention to the fact that in relation to land plots located within the boundaries of specially protected natural areas, changing the territorial zone will be contrary to the current legislation, — quotes the press service of the Government of Sevastopol Nikolai Gordyushin.

There have also been many requests to change the zone for collective gardening to a zone that provides for individual housing construction. On this issue, it was decided to provide for a separate territorial zone Zh-2.1.1. The main types of permitted use will include the type “For individual housing construction” (code 2.1), while its use is possible only after the approval of the documentation for planning the territory of the road network.

Such a zone will be provided for in the draft LPP if the decision of the general meeting of land owners is provided to the Department of Architecture before 15 September 2022 on the readiness to develop and approve the documentation for planning the territory of the road network — driveways, streets — in relation to the entire territory of the TSN, and also to carry out all the necessary work at their own expense, ”explained the Deputy Governor.

The changes also affected the garden plots, where the owners want to place objects of tourist services. To resolve this issue, the developer of the PZZ project will be recommended to determine the territorial zone R-4.1 — its urban planning regulations will allow the construction (use) of hotel services, but on condition that the owner of the land plot leaves the horticultural partnership. Also, the site must be adjacent to the common area.

In general, a lot of decisions have been made recommending the developer to make changes to the project in accordance with the data of the Unified State Register of Real Estate (Vishnevoe village, Veteran Aviation TSN, Alkadar ST, VEGA ZHSTIZ). Also, when finalizing the draft LPP, it is recommended that the developer conduct an additional analysis of the territorial zones, taking into account relevant information from the Unified State Register of Real Estate, determine the possibility of changing the territorial zone based on the presence of zones with special conditions for the use of the territory, information about cultural heritage sites and restrictions established by land and other legislation , to carry out additional analysis within the boundaries of dangerous geological processes , says Nikolai Gordyushin.

The Commission has already held a 21 meeting. In the future, monitoring of problematic issues and territories will continue in order to develop recommendations for the developer.

Recall that the conclusion and all minutes of the commission’s meetings will be sent to the developer to amend the draft rules for land use and development based on the results of public hearings. Then the project will be sent for approval to the Ministry of Culture of Russia.
