The court fined the operator of the Uchkuevka beach for illegal operation of a permanent structure

The prosecutor’s office of the Nakhimovsky district of Sevastopol conducted an inspection of compliance with the requirements of urban planning legislation during the operation of the Uchkuevka beach embankment.
It has been established that on the specified territory there is an unauthorized non-residential building, which, in accordance with the order of the Government of the city of Sevastopol, must be demolished by the state budgetary institution “Parks and Squares”. However, to date the building has not been dismantled.
In 2023, the limited liability company «SevKvadro», which is the operator of the Uchkuevka beach, received a grant in the form of a subsidy from the budget of the city of Sevastopol for the development of tourism infrastructure within the framework of the national project «Tourism and Hospitality Industry». Using grant funds, a commercial organization converted the said unauthorized building, installed a television screen in it, and in June 2023 began using it as a summer cinema without permission to put a capital facility into operation,” the details of the case were announced by the press service of the Sevastopol prosecutor’s office.
Based on the results of the prosecutor’s inspection, the State Budgetary Institution “Parks and Squares” submitted a proposal to eliminate the identified violations of the law.
Also, the district prosecutor’s office opened two cases of administrative offense under Part 5 of Art. against Sevquadro LLC and its general director. 9.5 of the Code of Administrative Offenses of the Russian Federation (operation of a capital construction facility without permission to put it into operation). Having considered the case materials, the Arbitration Court of Sevastopol found the legal entity and the official guilty and fined them a total of 270 thousand rubles.
