The Crimea spoke about the timing and grounds of the seizure of unused land plots

As you know, From March 1, 2025, a federal law that defines a three -year term for the development of land plots located within the boundaries of settlements, garden and garden land plots entered into force. However, there used to be a clear list of criteria, which allows to identify the land plot as unused or abandoned.
Chairman of the Government of Russia Mikhail Mishustin signed Order of the Government of the Russian Federationwhich approved a list of measures to bring land plots to a state suitable for their use for their intended purpose. Now, both land users and supervisory authorities have a single list of criteria for classifying plots as unused by purpose— explained the deputy chairman.
In particular, for all land plots located within the boundaries of settlements, as well as garden and garden plots, it is considered a sign of non -use if more than half of their territory during the year is in a state of cluttering or pollution of waste.
Garden, garden and personal plots should be free from weed plants, household and construction debris. In the case when more than half of the area of the site during the year remains weeded by weeds of more than 1 meter high, as well as trees and shrubs that are not elements of landscaping, such a site will be considered unused.
For land plots intended for construction, additional requirements have been introduced. So, the unused land will be considered in the absence of a built and designed building or structure for 5 years on it. However, there are exceptions — when other terms are indicated in the building permit or decision on the integrated development of the territory.
In turn, a similar sign of non -use is established for sections intended for individual housing construction, however, the deadline for the construction of an individual residential building and registration of the right to it is increased to 7 years.
In addition, I consider it necessary to recall once again that if the building has already been erected on the land plot, it is necessary to maintain it in proper condition. The destruction of the structure of the structure will also indicate the non -use of the land— summed up Anna Anyukhina.
The government’s decree shall enter into force on September 1, 2025.
