The Feodosia city court ordered the city administration to take measures to maintain the cultural heritage site

In February 2023, the deputy prosecutor of the city of Feodosia filed a lawsuit filed in defense of the rights, freedoms and legitimate interests of an indefinite number of persons against the administration of the city of Feodosia of the Republic of Crimea with demands to recognize the inaction as illegal, to compel them to perform certain actions.

According to the materials of the case, the prosecutor’s office of the city of Feodosia, when supervising the implementation of laws in force on the territory of the Russian Federation, found a violation of the requirements of federal legislation on the protection of cultural heritage objects in terms of ensuring their safety on the part of the administration of the city of Feodosia of the Republic of Crimea.

The inspection carried out by the prosecutor’s office found that the state of the cultural heritage site of federal significance «Tower of Giovanni di Scaffa XIV century» is partially functional: the walls are partially destroyed, there are numerous cracks, the territory of the cultural heritage site is littered, and also in violation of Part 1 of Art. 27 of Law No. 73-FZ, the administration of the city of Feodosiya of the Republic of Crimea, abstained from fulfilling the obligation to establish inscriptions and symbols containing information about a cultural heritage site, in accordance with the Procedure for their installation.

Based on the results of the audit of compliance with the requirements of federal legislation in this area, on February 25, 2022, the prosecutor’s office of the city of Feodosia submitted a proposal to the administration of the city of Feodosia of the Republic of Crimea to eliminate the identified violations, which have not yet been eliminated.

The representative of the administration of the city of Feodosia asked to consider the case without his participation and asked to refuse to satisfy the claims.

Taking into account the circumstances of the case, the opinions of the participants in the trial, the court partially satisfied the administrative claim of the deputy prosecutor of Feodosia.

The Feodosiya City Court of the Republic of Crimea declared illegal the inaction of the administration of the city of Feodosiya of the Republic of Crimea, expressed in the failure to take measures to organize measures on the territory of the municipality to preserve the cultural heritage site of federal significance «Tower of Giovanni di Scaffa XIV century», which is owned by the municipality of the city district of Feodosia of the Republic Crimea.

By its decision, the Feodosia City Court of the Republic of Crimea ordered the administration of the city of Feodosia of the Republic of Crimea to take measures to maintain the object of cultural heritage of federal significance «Giovanni di Scaffa Tower XIV century» in proper technical and sanitary condition, namely: within three months from the date the decision entered into legal the power to install an information inscription and signs on the object of cultural heritage of federal significance «Tower of Giovanni di Scaffa XIV century»; within one year from the date of entry into force of the court decision, to carry out conservation and emergency work to preserve the object of cultural heritage of federal significance «Tower of Giovanni di Scaffa XIV century» to prevent its further destruction, and also after one month after the deadline set by the court, inform to the court and the administrative plaintiff on the execution of the court decision in the administrative case.
