The law will define in detail how garage owners in a cooperative jointly manage their property.

State Duma Committee on State Construction and Legislation Russian newspaper, recommended the adoption in the second reading of a bill detailing how to manage garage associations: cooperatives, partnerships, etc. Anyone who has seen the Soviet film «Garage» knows what passions boil even among seemingly intelligent motorists. Do you think something has changed? No, practitioners say. In some ways it got even worse. But there is good news: problems will be solved. For the first time, the law will prescribe rules on how to swear, that is, excuse me, to negotiate among themselves the owners of garages.

The changes proposed by the bill will complete the comprehensive regulation of the garage sector, which is still missing, — Pavel Krasheninnikov, chairman of the State Duma Committee on State Construction and Legislation, one of the initiators of the project, told RG. — To date, the organization and activities of garage associations, as well as the rights and obligations of their members, remain unregulated.

He recalled that a “garage amnesty” is currently underway in the country, which affects the interests of millions of citizens. It will help to arrange a garage without unnecessary red tape. But getting a piece of paper that you are the owner is only half the battle. You have to get along with your neighbors somehow. This requires rules so that people can negotiate and resolve disputes in a civilized manner.

Pavel Krasheninnikov, chairman of the State Duma Committee on State Building and Legislation, explained that the proposed bill is intended to form a general approach to determining such real estate objects as garages and to their state registration. In particular, the document introduces the concepts of «territory of garage purpose», «garage complex».

So, a garage is a non-residential building intended solely for the storage of vehicles. Separate garages may have basements and no more than two ground floors. They can be free-standing or located within the boundaries of the garage area, they can be located in the same row with other garages and have common walls, a roof, a foundation and communications with them.

Thus, where three floors are no longer a garage. Bath, house, anything, but not a separate garage. But boxing in a series of their own kind is a real garage. Neighbors can unite and form a partnership. Particular attention in the bill is given to issues of common property and its management. In life, people often quarrel about this: who owns what, who should pay for what. Can someone privatize the gates in the garage complex and take money for each of their squeaks?

Now a clear answer will be given in the law: in garage associations there will be common property, which people must own together. No one can become the owner of a separate staircase or lamppost.

The project proposes a list of what belongs to the common property in the garage complex, namely auxiliary premises. For example: technical floors and basements, attics, stairs, elevators, corridors, roofs, enclosing load-bearing and non-bearing structures of the garage complex, mechanical, electrical and other equipment located in the garage complex.

The common property will be in the common shared ownership of the owners of parking spaces and non-residential premises. Each owner is obliged to participate in the payment of taxes, fees and other obligatory payments related to common property. Who suddenly starts to forget to pay bills, from that money can be recovered through the court. Comrades and neighbors.

Neither in Soviet times, nor in the post-Soviet period, we had a single legislative act dedicated to garage associations, Pavel Krasheninnikov emphasized. — Now there is no management scheme in this issue, there are problems with the use of common property belonging to members of garage associations. The bill is designed to clean up garages and protect the rights of their owners.

For creative people, this may be bad news. It looks like there will be less vital material for Garage-2. But we never learned how to adequately reshoot Soviet masterpieces, so that’s okay. And let the filmmakers look for ideas in some other areas. Life today already gives them enough food for thought.
