The nightmare of summer residents will not come true: roads in summer cottages will become common property

State Duma, reports «Russian newspaper», adopted in the third reading amendments to the Civil Code, detailing the rules for the use of common property. As lawyers explain, we are talking, for example, about common property in holiday villages or garage cooperatives.

Terrible dream of a summer resident: someone bought a private road and now you can’t drive up to the house without paying. Or someone has become the owner of the gate at the entrance and does not open them to everyone. And sometimes, according to his mood, he does not open to anyone at all. Alas, for many, terrible dreams have come true, since the relevant rules have not yet been spelled out. I would like to believe that after the entry into force of the new norms, the sleep of summer residents will become stronger.

As Pavel Krasheninnikov, chairman of the State Duma Committee on State Construction and Legislation, told RG, the law provides for the introduction of a new paragraph “Common property of owners of immovable things” into the Civil Code of the Russian Federation. Now, universal norms have been introduced into the Civil Code, which relate to common property in apartment buildings, and in private settlements on land, and in garage cooperatives. But there has long been no particular dispute about common corridors in apartment buildings. Because all issues are basically settled there. The problematic legal zone was just the settlements on the ground.

We continue to work on improving the systematization of civil legislation. The main provisions of the law will come into force on October 1, 2023, as time is needed to amend various acts regulating the legal regime of common property— Pavel Krasheninnikov explained.
