The President of the Notary Chamber of the city of Sevastopol took part in the public examination of the draft Federal Law No. 293466-8 in the Public Chamber of the Russian Federation

On September 22, 2023, the Commission of the Public Chamber of the Russian Federation on Public Expertise held a discussion of the draft Federal Law No. 293466-8 “On Amendments to the Fundamentals of the Legislation of the Russian Federation on Notaries.”
The event was attended by representatives of the notary office, the Public Chamber of the Russian Federation, representatives of the scientific community, professional translators and the Ministry of Justice of the Russian Federation.
The moderator of the discussion of the bill was the Chairman of the Commission of the RF OP for public examination of bills and other regulations, President of the Federal Notary Chamber Konstantin Korsik. The President of the Notary Chamber of the City of Sevastopol, Olga Kalenkovich, took part in the discussion remotely.
Those gathered set themselves the task of assessing the socio-economic consequences of the adoption of draft federal law No. 293466-8 “On Amendments to the Fundamentals of the Legislation of the Russian Federation on Notaries” and, if necessary, preparing proposals for finalizing the bill for the second reading in the State Duma of the Federal Assembly of the Russian Federation Federation.
In the context of the expansion of political and socio-economic ties of the Russian Federation with neighboring countries and an increase in the influx of foreign citizens to Russia, the need to translate documents issued in another state into Russian has increased significantly. As a rule, such translations are carried out by unofficial persons. Current legislation does not establish any requirements for the status of a translator in such cases, since this activity is not licensed. However, the possibility of further use of such translations, including for legal purposes, may cause difficulties. To fill this gap, the legislator is currently taking measures to resolve this issue through indirect regulation.
On May 18, 2023, the State Duma of the Federal Assembly of the Russian Federation adopted in the first reading the draft Federal Law No. 293466-8 “On Amendments to the Fundamentals of the Legislation of the Russian Federation on Notaries”, which proposes to impose on the notary the obligation, when certifying the authenticity of the translator’s signature, to check documents for compliance translator’s education to certain professional requirements.
It should be noted that currently, a notary, certifying the authenticity of the translator’s signature, establishes the translator’s qualifications based on his oral statements.
At the same time, it is important to take into account that the changes proposed by the bill in practice may lead to a decrease in the accessibility of this notarial act for citizens and cause difficulties due to the insufficient number of translators with the level of education established by the bill.
Based on the results of the legal examination, an appropriate conclusion will be prepared.
