It was established that the surviving spouse has the right to use the certificate of inheritance before issuing a certificate of inheritance without the consent of third parties by a vehicle, the owner of which in the registration documents is a member of his if such a vehicle was the joint property of the spouses.

Having survived a spouse who has the right to use such a vehicle, is entitled to demand transfer to him to own such a vehicle, which is owned by third parties, to put it on state registration for a limited period. The survivor of the spouse also has the right to demand the transfer of documents to him that identify such a vehicle.

A certificate of the right of the surviving spouse for temporary use by a vehicle, which was the property of a person who died (deceased) in connection with the participation of (completion of tasks) in his, is issued by a notary at the opening of the inheritance at the written application of the surviving spouse, provided that the period established by Article 1154 of the Civil Code of the Russian Federation for the acceptance of the inheritance is not expired.

The notary issues a certificate certifying the right of the surviving spouse for temporary use by such a vehicle before issuing a certificate of inheritance.
