The Saki District Court fined and expelled a foreigner from the country

On October 29, 2024, the Saki District Court of the Republic of Crimea examined the case materials against a 52-year-old citizen of the Republic of Tajikistan, who violated the regime of stay in the Russian Federation by committing an administrative offense, liability for which is provided for in Part 1.1 of Art. 18.8 Code of Administrative Offenses of the Russian Federation.
At the court hearing, the man did not deny the fact of violating the regime of stay and committing an administrative offense, explaining that he did not leave the territory of the Russian Federation within the prescribed period due to lack of funds.
Having examined and assessed the evidence available in the case, the court came to the conclusion that the foreigner was guilty of committing an administrative offense, since the lack of funds is not a basis for failure to comply with the established Federal Law of July 25, 2002 No. 115-FZ “On the legal status of foreign citizens in the Russian Federation”. Federation» obligation to leave the Russian Federation upon expiration of the temporary stay. The court also took into account the long period of time of illegal residence in the Russian Federation of the citizen involved, his lack of a source of income, the presence of police reports, the failure to take appropriate measures to eliminate the current situation and legalize his stay on the territory of the Russian Federation, which indicates his obvious disregard for the provisions established in the Russian Federation Federation of Law and Order.
By the decision of the Saki District Court of the Republic of Crimea, a citizen of the Republic of Tajikistan was found guilty of committing an administrative offense under Part 1.1 of Art. 18.8 of the Code of Administrative Offenses of the Russian Federation, he was sentenced to an administrative fine in the amount of 4,000 rubles with administrative deportation from the Russian Federation in the form of forced deportation.
