A businessman and a resident of Shchelkino, who illegally built a cafe on the city’s waterfront, was left without earnings during the holiday season. At the same time, the entrepreneur also ignored the court decision to demolish the building belonging to him.
Based on this, the employees of the bailiff department for the Leninsky district of the GUFSSP of Russia for the Republic of Crimea and the city of Sevastopol initiated enforcement proceedings against the debtor. Nevertheless, citizen Zh. did not consider it necessary to comply with the court decision and, as a result, the bailiffs of the department drew up 2 protocols against the businessman under Parts 1 and 2 of Art. 17.15 of the Code of Administrative Offenses of the Russian Federation, and also imposed on him a performance fee in the amount of 5 thousand rubles. The measures taken by the bailiffs did not have the desired effect on citizen Zh., who by that time already lived in the territory of one of the states of the Middle East and acted in the Republic of Crimea through his representative— reported the press service of the GUFSSP of Russia for the Republic of Crimea and the city of Sevastopol.
In this regard, representatives of the claimant — the city administration, proposed to demolish the object with the help of a third-party contractor. Guided by Art. 107 FederalWow lawA No. 229-FZ of October 2, 2007 (as amended on December 29, 2022, as amended on April 26, 2023) “On Enforcement Proceedings” (as amended and supplemented, effective from January 9, 2023) employees of the bailiffs department for the Leninsky district of the GUFSSP of Russia for the Republic of Crimea and the city of Sevastopol issued a decision to involve a specialized organization in the demolition of an illegally erected building and sent a corresponding request to the representative of citizen Zh, according to which the building to be demolished should be freed from the property located there by the set date .
Within the specified period, the bailiffs of the department, representatives of the claimant and the company involved in the demolition of the illegally erected cafe arrived at the facility, where, in the presence of a representative of citizen G., an act was drawn up to open the premises, the fact of its disconnection from third-party communications was recorded. After that, the construction company began to dismantle and demolish the facility. Over the next two weeks, the unauthorized cafe built will be completely demolished, and park zone facilities will be built in its place. The funds spent by the claimant’s representatives to pay for the services of demolition specialists and equipment will be recovered from citizen G. at the expense of the latter’s property and funds.
The GUFSSP of Russia for the Republic of Crimea and the city of Sevastopol calls on citizens to conduct business in accordance with the norms of Russian legislation, respect state property and voluntarily comply with the court decision on time and in full!
