The State Duma announced what summer problems most often arise among citizens

State Duma deputy (United Russia faction), chairman of the Union of Summer Residents of the Moscow Region Nikita Chaplin in a commentary «Rossiyskaya Gazeta» clarified the solution to important problems that gardeners most often face.

When purchasing a dacha, many citizens do not know the intricacies, which later become a big problem. And the most common of them occurs when citizens acquire a garden plot, plan to live there permanently and begin to demand that the board provide all the benefits, the deputy said. Therefore, when buying such a plot, according to him, it is worth learning that everything is decided by the general meeting of members and the financial capabilities of the garden partnership.

All the main provisions that a summer resident needs to know are spelled out in the Federal Law of July 29, 2017 No. 217, which regulates relations arising in connection with the maintenance of gardening and horticulture by citizens for their own needs.

The most heated disputes arise because of the payment of membership dues. According to the norms of the law, payment can be made exclusively to the current accountChaplin said. — There can be no «requisitions» for cash.

He noted that the owner of a land plot in SNT has the right to run his household on an individual basis without entering into a partnership, but he still has to pay for connected communications (garbage disposal, electricity) in an amount not less than the size of membership fees.

The parliamentarian also warned against possible disputes with neighbors.

According to the statistics of requests that come to us to the Union of Summer Residents and the State Duma, the most common problems are related to the presence of a registry error in the coordinates of the corner points of the plot boundaryChaplin noted. — That is, there is no dispute on the fact, but according to the documents, there is. And in connection with this oversight, one of the owners cannot register his plot and his house.

According to him, it is important here to talk peacefully with neighbors and correct the mistake using the services of a cadastral engineer.

But, unfortunately, most often this issue ends up in court, he stated.

The second place in the ranking of the most common disputes with neighbors is the darkening of adjacent areas.

If your tree or a new building obscures the neighbor’s site, then he has the right to demand a solution to the problem through the competent authorities: you can be fined and issued an order to eliminate this problem (demolish the building, cut the branches of the tree)the MP said.

And the third problem is the silence mode.

Neighbors may turn out to be elderly people and they may be annoyed by your nightly gatherings with friendshe noted. — You can listen to music, sing and have fun in the country from 7:00 to 23:00. But some regions have their own peculiarities, for example, you can make noise until 22:00.

The size of the fine varies from region to region. “And be sure to remember that it is better to try to negotiate with a neighbor than to bring the case to court,” the deputy concluded.
