Deputy Konstantin Zatulin and Senator Sergei Tsekov, reports TASS, introduced a bill to the State Duma to invalidate the decision to transfer the Crimean region from the RSFSR to the Ukrainian SSR in 1954. The corresponding bill is posted in the Duma electronic database.

According to Article 1 of the draft federal law, the decision to transfer the Crimean region from the RSFSR to the Ukrainian SSR, adopted in 1954 by normative legal acts that do not have legal force, in violation of the Constitution of the RSFSR and the Constitution of the USSR, is proposed to be recognized as illegal, not in accordance with the fundamental principles of the rule of law and international law.

In addition, the Russian Federation, as the successor to the USSR and the RSFSR, “considering the decision to transfer the Crimean region without taking into account the will of the Russian people as a political crime, overcoming the consequences of voluntarism, striving for historical justice and legality, recognizes the law as invalid and not giving rise to legal consequences from the moment of adoption” USSR of April 26, 1954 and all other decisions of 1954 related to the transfer of Crimea.

As stated in the explanatory note, the document is aimed “to cleanse the legal heritage of the Russian Federation as the legal successor of the USSR and the RSFSR from insignificant acts that had no legal basis, but gave rise to lawlessness, political crimes based on abuse of power, which caused enormous damage to the sovereign rights of the Russian Federation and the interests of the Russian Federation.” people.»

Parliamentarians note that according to the 1936 Constitution of the USSR, the Union government bodies were not endowed with the right to make decisions on the transfer of territories from one Union republic to another; they only had the authority to approve changes in the borders between them. The developers also note that a referendum on the ownership of Crimea was not held in 1954, unlike in 2014.

Consequently, the acts of 1954 on the transfer of the Crimean region from the RSFSR to the Ukrainian SSR were adopted by government bodies of the RSFSR, Ukrainian SSR and the USSR, which were not competent to resolve such issues, in violation of the Constitutions of the RSFSR, Ukrainian SSR and the USSR in force at that time, — says the explanatory note.

Zatulin and Tsekov also indicate that the decision was made by the USSR in favor of the Ukrainian SSR — which, like the RSFSR, was part of the United Nations at that time.

Consequently, the USSR, RSFSR and Ukrainian SSR were fully subject to the requirements of the UN Charter, according to which relations between them were to be based on the principle of “sovereign equality” and formalized by international legal acts, that is, an interstate treaty or agreement. This requirement was not fulfilled,” is emphasized in the accompanying documents.

Restoring historical justice

Parliamentarians note that 60 years later, historical justice was restored when, following the results of the all-Crimean referendum held on March 16, 2014, the peninsula was reunited with the Russian Federation. They are convinced that Russia, as the legal successor of the USSR, has the right and must recognize the decision to transfer the Crimean region as illegal, criminal and not giving rise to legal consequences and cancel it “not only for reasons of restoring historical justice or “proving what has been proven,” that is, the return of Crimea and Sevastopol into the Russian Federation based on the 2014 referendum.”

The invalidation of the 1954 decision to transfer the Crimean region to the Ukrainian SSR knocks the ground out from under the propaganda of today’s Ukrainian authorities, who are actively introducing into the consciousness of their own population and the whole world the thesis about the “occupation” of Crimea by Russia in 2014.
