Threat of murder and fake ID led to real imprisonment of Crimean man

The Leninsky District Court of the Republic of Crimea has sentenced a 33-year-old previously convicted resident of the city of Shchelkino in the Leninsky District for committing two crimes.
During the trial, it was established that at the end of July 2023, the defendant, on the basis of personal hostility that he had previously developed with the victim, entered into a conflict on the road leading to the Shchyolkino Nuclear Power Plant, due to the breakdown of the car of their mutual female friend. During the conflict, the defendant began waving a knife, wanted to cause the man fear and concern for his life, and threatened to kill. The man, taking into account the aggressive and excited state of the defendant and the presence of a knife in his hands, perceived his actions as a real threat, and feared for his life. The victim took a traumatic pistol from the car and fired a warning shot into the air. However, the defendant did not react to this and continued to threaten with a knife, subsequently a fight ensued, during which the knife was knocked out of the defendant’s hands. Police officers later arrived at the scene, — the court’s press service reported.
Also, in May of last year, the defendant illegally ordered and received from an unidentified person a driver’s license, giving him the right to drive vehicles. This fact was later revealed by traffic police officers.
At the court hearing, the defendant fully admitted his guilt only in committing the crime concerning the counterfeit ID.
The court qualified his actions as a threat to kill when there were grounds to fear that this threat would be carried out (Article 119, Part 1 of the Criminal Code of the Russian Federation), as well as the acquisition, storage for the purpose of use, and use of a knowingly counterfeit ID (Article 327, Part 3 of the Criminal Code of the Russian Federation).
The court, having thoroughly examined the case materials, taking into account the circumstances of the crime, information about the personality of the defendant, sentenced him to imprisonment for a term of 1 (one) year 2 (two) months 10 (ten) days and a fine of 15,500 (fifteen thousand five hundred) rubles, with the sentence to be served in a penal colony.
The sentence has not entered into legal force.
