Use of joint property by members of the SNT: changes have been made to the Federal Law

Deputy Chairman of the Council of Ministers of the Republic of Crimea Anna Anyukhina recalled the changes made to Federal Law No. 312-FZ of July 14, 2022, regarding the use of joint property by SNT members. The Deputy Prime Minister said that the procedure for joint ownership, use and disposal of common property in the territory where citizens conduct gardening and horticulture for their own needs has been clarified.
So, clarity has been clarified in terms of the definition of the concept of “common property”, which means land plots located within the boundaries of the territory where citizens conduct gardening or horticulture for their own needs, as well as real estate and other objects located on them, used to meet the general needs of citizens engaged in horticulture and horticulture in the specified territory.the Deputy Prime Minister explained.
Sports and playgrounds, gas supply, heat supply, electricity, water supply, sanitation and other elements necessary to meet the needs of members of the partnership may be located on land plots for common use.
In addition, in accordance with the decision of the general meeting, it is allowed to use general-purpose land plots by citizens and organizations for the sale of goods, work and services for the needs of members of the SNT. For these purposes, even the construction of non-capital buildings is allowed on general-purpose land plots.
However, the deputy chairman emphasized that the decision to transfer land plots and real estate objects located on them, related to common use property, to other persons or organizations for rent or free use, as well as the decision to establish an easement in relation to such property, as well as determining the conditions for its use, is referred to the exclusive competence of the general meeting of members of the partnership.
