Without inconvenience to neighbors: the State Duma adopted a law on daily rental of apartments

The document was prepared in pursuance of the decision of the Constitutional Court. It is stipulated that the owner can rent out an apartment to citizens under a lease agreement, including short-term or free use, as well as to companies under a lease agreement — but only on condition that the rights and legitimate interests of neighbors, the rules for the use of residential premises and the maintenance of a common building are ensured property.
Compliance with these rules will be a condition for concluding a short-term rental agreement. The first deputy chairman of the State Duma Committee on Construction and Housing and Public Utilities, Vladimir Koshelev, previously explained to RG what this means in practice: not only “daily tenants,” but also the owner of such premises will be held responsible for noise, disorder and damage to common property. He also promised that the topic would be continued: the relevant committee has already developed a bill stating that the owner who rents out residential premises must obtain consent from the owners of neighboring and adjacent apartments.
Member of the Budget and Tax Committee Nikita Chaplin clarified that in 2023, tenants’ income from short-term rentals amounted to more than 213 billion rubles, “but often this money was received to the detriment of neighbors.” He, in addition, named another bonus from the adoption of the law, in addition to putting things in order in the field of hiring, — an increase in tax revenues to the Russian budget.
The new law, among other things, prohibits daily renting of apartments that do not have metering devices. For example, this is especially true when a dozen migrant workers are accommodated in an apartment.
In addition, when renting out an apartment, it must be mandatory to comply with sanitary and hygienic standards and pay all utility costs. If the provision of such residential premises violates the housing rights of citizens living in the apartment building in which it is located, citizens whose housing rights have been violated have the right to seek their protection in court.
In essence, the bill establishes the line when a bona fide tenant turns into a malicious daily guest and vice versa,” Alexey Govyrin, a member of the State Duma Committee on Small and Medium Enterprises, explained to RG. — That is, for some reason, earlier courts made decisions in which there was a tendency that long-term tenants are more conscientious than those who rent apartments on a daily basis.
However, in practice, it happens that premises with daily rentals are kept clean, but those with long-term rentals are drowned in dirt.

Residents of apartment buildings should have the right not to want daily rentals in a neighbor’s apartment with the corresponding flows of various people, increased commercial traffic, and increased noise— the deputy believes, — and neighbors of noisy long-term tenants should have the right to take legal action, for example, because of performances that intensify on weekends.
