“Dacha amnesty” proposed to be extended again

The Committee on State Building and Legislation recommended adopting in the second reading a bill extending the so-called dacha amnesty. This was reported by «Rossiyskaya Gazeta» Committee Chairman Pavel Krasheninnikov.
The bill refers to buildings and structures in SNT that were built before December 30, 2004 and that belong to common property, — said Pavel Krasheninnikov. — These, for example, could be garages, gatehouses, water towers, etc. The possibility of simplified registration of such objects should have expired on January 1, 2024. We propose to equalize the terms with the terms of the general amnesty for garden and residential houses of citizens and the simplified free privatization of land plots, that is, until March 1, 2031,” he said.
The initiative was taken by a group of senators and deputies, including Andrei Turchak and Pavel Krasheninnikov.
Experts remind that to register buildings and structures for public use in a simplified manner, a title document, a declaration drawn up by the chairman of the partnership, without preparing a technical plan, is sufficient. The document must be submitted to the MFC or posted on the State Services portal. But one of the main reasons for the delays is the lack of registered rights to the land plots on which certain public facilities are located.
Pavel Krasheninnikov noted that if the simplified procedure is cancelled, then such buildings will only be able to be registered by a court decision, subject to confirmation of their compliance with building codes and regulations.
According to the authors of the bill, not all horticultural and vegetable gardening non-profit partnerships have realized the opportunity to register rights in a “simplified manner” to such objects, including due to the lack of registered rights to the land plots on which such objects are located.

There is also a so-called garage amnesty taking place now. It allows citizens, until September 1, 2026, to obtain free ownership of state and municipal land plots on which their garages are located.
This “amnesty” applies to permanent garages built before the entry into force of the Town Planning Code of the Russian Federation (before December 30, 2004) and located on state or municipal land. At the end of last year, Rosreestr reported that as part of the “garage amnesty” at that time, more than 260 thousand garages and land plots under them were registered. The “garage amnesty” is most popular in Tatarstan, Moscow, Yaroslavl, Leningrad and Saratov regions.
